A bill to amend 1974 PA 258, entitled
"Mental health code,"
by amending sections 212 and 216 (MCL 330.1212 and 330.1216), as
amended by 1995 PA 290.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 212. Upon electing to establish a community mental
2 health services program, the county or combination of counties
3 shall establish a 12-member community mental health services
4 board, except as provided in section 214, 216, 219, or 222(2) or
5 (5). Each board of commissioners shall by a majority vote
6 appoint the board members from its county. Recommended
7 appointments to the board shall be made annually following the
8 organizational meeting of the board of commissioners.
9 Sec. 216. Notwithstanding the provisions of sections 212
10 and 214, when a single county establishes a community mental
1 health services program and totally situated within that county
2 is a city having a
population of at least 500,000, 6 the county
3 shall establish a board having 13 members. Six of the 12 13
4 board members shall be appointed to the board by the city's chief
5 executive officer with the advice and consent of the city
6 council. In a charter
county, the remaining 6 7 members shall
7 be appointed to the board by the county's chief executive
8 officer, with the advice and consent of the county board of
9 commissioners. The 6 board members appointed by the city shall
10 be residents of the city, and the 6 board members appointed by
11 the county or by the county executive in a charter county shall
12 be residents of the
county but not and at least 1 of those
13 members shall be a resident of the city.
