A bill to amend 1976 PA 451, entitled
"The revised school code,"
(MCL 380.1 to 380.1852) by adding section 1240.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 1240. (1) Subject to subsections (2) and (3), the
2 board of a school district that has a membership of at least
3 20,000 pupils may employ public safety officers or police
4 officers and may grant to the public safety officers or police
5 officers of that school district the powers and authority of a
6 peace or law enforcement officer. Public safety officers or
7 police officers granted the powers and authority under this
8 section shall have the same powers and authority of a peace
9 officer under the code of criminal procedure, 1927 PA 175,
10 MCL 760.1 to 777.69, and as provided under the Michigan vehicle
11 code, 1949 PA 300, MCL 257.1 to 257.923.
1 (2) Before granting the powers and authority of a peace or
2 law enforcement officer as described in subsection (1), the board
3 of a school district shall conduct at least 2 public hearings.
4 (3) The board of a school district shall not grant the powers
5 and authority described in subsection (1) unless the board
6 creates a public safety advisory committee. The public safety
7 advisory committee shall be composed of at least 3 and not more
8 than 5 members appointed by the chief administrator of the school
9 district with the concurrence of the board of the school
10 district. The public safety advisory committee shall receive and
11 address grievances by persons against the public safety officers
12 or police officers or against the public safety department or
13 police department of that school district. The committee may
14 recommend to the board or the administration of that school
15 district that disciplinary measures be taken against a public
16 safety officer or police officer who is found responsible for
17 misconduct in office.
18 (4) Subject to subsection (5), the jurisdiction of public
19 safety officers or police officers granted powers and authority
20 of peace or law enforcement officers under this section shall
21 include all territory within the boundaries of the school
22 district and all property outside the boundaries of the school
23 district that is owned, leased, or rented by or is otherwise
24 under the legal control of the school district that employs the
25 public safety officers.
26 (5) The public safety department or police department of a
27 school district and each local law enforcement agency with which
1 it has overlapping jurisdiction shall enter into a memorandum of
2 understanding that establishes reasonable communication and
3 coordination efforts between the department and the agency.
4 (6) Public safety officers or police officers of a school
5 district to whom the powers and authority of a peace or law
6 enforcement officer are granted under this section shall meet the
7 minimum standards of the commission on law enforcement standards
8 act, 1965 PA 203, MCL 28.601 to 28.616.
9 (7) The public safety department or police department of a
10 school district shall submit monthly uniform crime reports
11 pertaining to crimes within the department's jurisdiction to the
12 department of state police in the same manner as uniform crime
13 reports are submitted under section 1 of 1968 PA 319, MCL 28.251.
