A bill to amend 1961 PA 236, entitled
"Revised judicature act of 1961,"
(MCL 600.101 to 600.9948) by adding section 181.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 181. (1) The justice system fund is created in the
2 state treasury. The money in the fund shall be used as provided
3 in this section.
4 (2) The state treasurer shall credit to the justice system
5 fund deposits of proceeds from the collection of revenue from
6 court assessments and costs designated by law for deposit in the
7 fund and shall credit all income from investment credited to the
8 fund by the state treasurer. The state treasurer may invest
9 money in the fund in any manner authorized by law for the
10 investment of state money. However, an investment shall not
11 interfere with any apportionment, allocation, or payment of money
1 as required by this section. The unencumbered balance remaining
2 in the fund at the end of a fiscal year shall remain in the fund
3 and shall not revert to the general fund.
4 (3) In the state fiscal year beginning October 1, 2003, the
5 state treasurer shall distribute the proceeds of the fund monthly
6 as follows:
7 (a) To the highway safety fund created in section 629e of the
8 Michigan vehicle code, 1949 PA 300, MCL 257.629e, 11.3% of the
9 fund balance.
10 (b) To the jail reimbursement program fund created in section
11 629e of the Michigan vehicle code, 1949 PA 300, MCL 257.629e,
12 11.5% of the fund balance.
13 (c) To the secondary road patrol and training fund created in
14 section 629e of the Michigan vehicle code, 1949 PA 300,
15 MCL 257.629e, 22.6% of the fund balance.
16 (d) To the Michigan justice training fund created in section
17 5 of 1982 PA 302, MCL 18.425, 11.3% of the fund balance.
18 (e) To the secretary of the legislative retirement system for
19 deposit with the state treasurer in the retirement fund created
20 in the Michigan legislative retirement system act, 1957 PA 261,
21 MCL 38.1001 to 38.1080, 1% of the fund balance.
22 (f) To the drug treatment courts fund created in section 185,
23 2.0% of the fund balance.
24 (g) To the state forensic lab fund created in section 3 of
25 the forensic laboratory funding act, 1994 PA 35, MCL 12.203, 3.3%
26 of the fund balance.
27 (h) To the state court fund created in section 151a, 12.5% of
1 the fund balance.
2 (i) To the court equity fund created in section 151b, 22.5%
3 of the fund balance.
4 (j) To the state treasurer for monitoring of collection and
5 distribution of fund receipts, 1% of the fund balance.
6 (k) To the state court administrative office for management
7 assistance and audit of trial court collections, 1% of the fund
8 balance.
9 (4) In the state fiscal year beginning October 1, 2004 and
10 each fiscal year following, the state treasurer shall distribute
11 the proceeds of the fund monthly as follows:
12 (a) To the highway safety fund created in section 629e of the
13 Michigan vehicle code, 1949 PA 300, MCL 257.629e, 11% of the fund
14 balance.
15 (b) To the jail reimbursement program fund created in section
16 629e of the Michigan vehicle code, 1949 PA 300, MCL 257.629e, 11%
17 of the fund balance.
18 (c) To the secondary road patrol and training fund created in
19 section 629e of the Michigan vehicle code, 1949 PA 300,
20 MCL 257.629e, 21.5% of the fund balance.
21 (d) To the Michigan justice training fund created in section
22 5 of 1982 PA 302, MCL 18.425, 11% of the fund balance.
23 (e) To the secretary of the legislative retirement system for
24 deposit with the state treasurer in the retirement fund created
25 in the Michigan legislative retirement system act, 1957 PA 261,
26 MCL 38.1001 to 38.1080, 1% of the fund balance.

14 Enacting section 1. This amendatory act takes effect
15 October 1, 2003.
