A bill to amend 1991 PA 179, entitled
"Michigan telecommunications act,"
(MCL 484.2101 to 484.2701) by adding section 364.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 364. (1) A telecommunication provider of basic local
2 exchange service shall not refuse to transfer or delay the
3 transfer of a basic local exchange service customer to another
4 provider of basic local exchange service.
5 (2) Within 90 days after the effective date of the amendatory
6 act that added this section, the commission shall establish by
7 order uniform statewide standards and procedures for the timely
8 transfer of customers between providers of basic local exchange
9 service, including uniform maximum time periods within which a
10 customer's current provider shall effect a transfer of the
11 customer to the customer's chosen new provider.
1 (3) The procedures and time periods established under
2 subsection (2) shall be consistent with any applicable procedures
3 and time periods established by the federal communications
4 commission.
5 (4) Until the procedures and time periods are established
6 under subsection (2), a basic local exchange provider shall
7 perform all of the operations necessary for the timely transfer
8 of customers, in accordance with the performance standards and
9 measurements previously established by the commission for the
10 largest incumbent basic local exchange service provider in this
11 state.
