                                                                                 A bill to amend 1931 PA 328, entitled                                             

                                                                                

    "The Michigan penal code,"                                                  

                                                                                

    (MCL 750.1 to 750.568) by adding section 81e.                               

                                                                                

                THE PEOPLE OF THE STATE OF MICHIGAN ENACT:                      

                                                                                

1       Sec. 81e.  (1) An individual who assaults and batters                       

                                                                                

2   another individual under any of the following circumstances and             

                                                                                

3   causes any physical injury to that other individual is guilty of            

                                                                                

4   a felony punishable by imprisonment for not more than 4 years or            

                                                                                

5   a fine of not more than $2,000.00, or both:                                 

                                                                                

6       (a) The other individual is an employee of a public transit                 

                                                                                

7   authority and is operating a public transit vehicle or is                   

                                                                                

8   performing duties associated with the operation of a public                 

                                                                                

9   transit vehicle.                                                            

                                                                                

10      (b) The other individual is a passenger on a public transit                 

                                                                                

11  vehicle or is entering into or exiting from a public transit                

                                                                                


                                                                                

1   vehicle.                                                                    

                                                                                

2       (c) The other individual is in a location designated in                     

                                                                                

3   compliance with state or local law as an area for use by public             

                                                                                

4   transit vehicles in picking up or discharging passengers.                   

                                                                                

5       (d) The other individual is in a facility or area that is                   

                                                                                

6   owned or operated by a public transit authority and that is for             

                                                                                

7   use in providing transportation services to the general public,             

                                                                                

8   including a parking lot for visitors.                                       

                                                                                

9       (2) As used in this section:                                                

                                                                                

10      (a) "Public transit authority" means an entity of a local                   

                                                                                

11  unit of government of this state or a combination of local units            

                                                                                

12  of government of this state that is authorized by law to provide            

                                                                                

13  transportation services to the general public.                              

                                                                                

14      (b) "Public transit vehicle" means a vehicle used by a                      

                                                                                

15  public transit authority to provide transportation services to              

                                                                                

16  the general public.
