A bill to amend 1969 PA 317, entitled
"Worker's disability compensation act of 1969,"
(MCL 418.101 to 418.941) by adding section 853a.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 853a. (1) A person who makes a claim under this act
2 may submit a written request to an employer, carrier, principal,
3 or subcontractor for information relating to the claim that is in
4 the possession of the employer, carrier, principal, or
5 subcontractor. The employer, carrier, principal, or
6 subcontractor shall provide the requested information to the
7 person, or a written statement specifying that it does not have
8 the information, within 30 days after receiving the request.
9 (2) An employer, carrier, principal, or subcontractor who
10 violates this section shall pay to the person described in
11 subsection (1) $50.00 per day for each day after the time period
1 prescribed in subsection (1) that information or a statement
2 required under this section is not provided.
3 (3) As used in this section, "information" includes but is
4 not limited to data, reports, and records relating to an incident
5 or injury that underlies a claim.
