SUBSTITUTE FOR
SENATE BILL NO. 1267
A bill to amend 1986 PA 32, entitled
"Emergency telephone service enabling act,"
by amending section 317 (MCL 484.1317) and by adding section
317a.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 317. Name, address, and telephone number information
2 provided to a 9-1-1 system by a service supplier shall be used
3 only for the purpose of identifying the telephone location or
4 identity, or both, of a person calling the 9-1-1 emergency
5 telephone number and shall not be used or disclosed by the 9-1-1
6 system agencies, their agents, or their employees for any other
7 purpose, unless such the
information is used or disclosed as
8 otherwise required under this act, to a member of a public safety
9 agency if necessary to respond to events or situations that are
10 dangerous or threaten individual or public safety, or pursuant to
1 a court order. A person who violates this section is guilty of a
2 misdemeanor.
3 Sec. 317a. (1) A 9-1-1 service district may implement an
4 emergency notification system that will allow emergency service
5 responders to contact service users within a specific geographic
6 area regarding an imminent danger or emergency that may affect
7 the user's health, safety, or welfare.
8 (2) A person that provides an emergency notification system
9 allowed under this section is a service supplier under section
10 604.
11 (3) A service supplier shall upon request provide to each
12 9-1-1 service district within the provider's service area the
13 telephone number and address data, including all listed,
14 unlisted, and unpublished numbers and addresses, for each service
15 user within the district.
16 (4) A service supplier may charge a reasonable rate to
17 provide the data required under subsection (3).
18 (5) A 9-1-1 service district shall not request the data
19 required under subsection (3) more than once per month.
20 (6) The data provided under subsection (3) shall be used only
21 for the purposes provided under this section.
22 (7) This section does not apply to a wireless carrier. As
23 used in this subsection, "wireless carrier" means a provider of
24 2-way cellular, broadband PCS, geographic area 800 MHz and 900
25 MHz commercial mobile radio service, wireless communications
26 service, or other commercial mobile radio service as defined by
27 the federal communications commission, that offers radio
1 communications that may provide fixed, mobile, radio location, or
2 satellite communication services to individuals or businesses
3 within its assigned spectrum block and geographical area or that
4 offers real-time, 2-way voice or data service that is
5 interconnected with the public switched network, including a
6 reseller of the service.
7 (8) A person who violates this section is guilty of a
8 misdemeanor.
