SUBSTITUTE FOR
SENATE BILL NO. 1075
A bill to amend 1978 PA 368, entitled
"Public health code,"
by amending sections 17049 and 17549 (MCL 333.17049 and
333.17549), as added by 1990 PA 247.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 17049. (1) In addition to the other requirements of
2 this section and subject to subsection (5), a physician who
3 supervises a physician's assistant is responsible for all of the
4 following:
5 (a) Verification of the physician's assistant's credentials.
6 (b) Evaluation of the physician's assistant's performance.
7 (c) Monitoring the physician's assistant's practice and
8 provision of medical care services.
9 (2) Subject to section 17048, a physician who supervises a
10 physician's assistant may delegate to the physician's assistant
1 the performance of medical care services for a patient who is
2 under the case management responsibility of the physician, if the
3 delegation is consistent with the physician's assistant's
4 training.
5 (3) A physician who supervises a physician's assistant is
6 responsible for the clinical supervision of each physician's
7 assistant to whom the physician delegates the performance of
8 medical care service under subsection (2).
9 (4) Subject to subsection (5), a physician who supervises a
10 physician's assistant shall keep on file in the physician's
11 office or in the health facility or agency or correctional
12 facility in which the physician supervises the physician's
13 assistant a permanent, written record that includes the
14 physician's name and license number and the name and license
15 number of each physician's assistant supervised by the
16 physician.
17 (5) A group of physicians practicing other than as sole
18 practitioners may designate 1 or more physicians in the group to
19 fulfill the requirements of subsections (1) and (4).
20 (6) Notwithstanding any law or rule to the contrary, a
21 physician is not required to countersign orders written in a
22 patient's clinical record by a physician's assistant to whom the
23 physician has delegated the performance of medical care services
24 for a patient.
25 Sec. 17549. (1) In addition to the other requirements of
26 this section and subject to subsection (5), a physician who
27 supervises a physician's assistant is responsible for all of the

2 (a) Verification of the physician's assistant's credentials.
3 (b) Evaluation of the physician's assistant's performance.
4 (c) Monitoring the physician's assistant's practice and
5 provision of medical care services.
6 (2) Subject to section 17548, a physician who supervises a
7 physician's assistant may delegate to the physician's assistant
8 the performance of medical care services for a patient who is
9 under the case management responsibility of the physician, if the
10 delegation is consistent with the physician's assistant's
11 training.
12 (3) A physician who supervises a physician's assistant is
13 responsible for the clinical supervision of each physician's
14 assistant to whom the physician delegates the performance of
15 medical care service under subsection (2).
16 (4) Subject to subsection (5), a physician who supervises a

19 facility in which the physician supervises the physician's
20 assistant a permanent, written record that includes the
21 physician's name and license number and the name and license
22 number of each physician's assistant supervised by the
