SENATE BILL No. 516

May 22, 2003, Introduced by Senators JACOBS, CASSIS, BARCIA, McMANUS, BRATER, BASHAM and BIRKHOLZ and referred to the Committee on Families and Human Services.

                                                                             A bill to amend 1939 PA 288, entitled                                             

"Probate code of 1939,"                                                     

by amending section 22a of chapter X (MCL 710.22a), as added by             

1994 PA 430.                                                                

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

1                               CHAPTER X                                       

2       Sec. 22a.  A child shall not be placed with a prospective                   

3   adoptive parent and an adoption order shall not be issued if a              

4   person authorized to place the child or the court authorized to             

5   issue the order has reliable information that the prospective               

6   adoptive parent has been convicted under any of the following:              

7       (a) Section 145a or 145c of the Michigan penal code,  Act                   

8   No. 328 of the Public Acts of 1931, being sections 750.145a and             

9   750.145c of the Michigan Compiled Laws 1931 PA 328, MCL 750.145a           

10  and 750.145c.                                                               

1       (b) Sections 520b to 520g of the Michigan penal code,  Act                  

2   No. 328 of the Public Acts of 1931, being sections 750.520b to              

3   750.520g of the Michigan Compiled Laws, if the victim was under             

4   the age of 18 at the time the crime was committed 1931 PA 328,             

5   MCL 750.520b to 750.520g.                                                   

6       (c) A law of another state substantially similar to 1 of the                

7   sections included in subdivision (a) or (b).
