SUBSTITUTE FOR
SENATE BILL NO. 179
A bill to amend 1976 PA 451, entitled
"The revised school code,"
(MCL 380.1 to 380.1852) by adding section 1523.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 1523. (1) Except as otherwise provided in this
2 subsection, the board of a school district or local act school
3 district or board of directors of a public school academy shall
4 require each person it employs as a coach of an interscholastic
5 athletic activity, or assigns to serve as a coach of an
6 interscholastic athletic activity, to hold valid certification in
7 sport safety training. Certification in sport safety training
8 may be achieved by successful completion of a sport safety
9 training course approved by the state board. The sport safety
10 training course shall include instruction in at least
11 cardiopulmanary resuscitation, emergency procedures, first aid,
1 and injury prevention. This requirement does not apply to any of
2 the following:
3 (a) A person who is employed or serving as an interscholastic
4 athletic coach in this state as of the effective date of this
5 section or who has been employed or served as an interscholastic
6 athletic coach in this state before the effective date of this
7 section.
8 (b) A person who demonstrates that he or she has physical
9 limitations that make it impracticable for the person to complete
10 the course and obtain the required certification under this
11 subsection.
12 (c) A person who is licensed under part 170, 172, 175, or 209
13 of the public health code, 1978 PA 368, MCL 333.1101 to
14 333.25211.
15 (2) A person who holds the sport safety certification
16 described in this section and who in an emergency provides
17 physical aid within the scope of the sport safety training to
18 another person in the course of his or her employment or service
19 as an interscholastic athletic coach is not liable in a civil
20 action for damages resulting from an act or omission occurring in
21 providing that aid except an act or omission constituting gross
22 negligence or willful and wanton misconduct.
23 (3) This section does not create a duty to act on the part of
24 a person who holds sport safety certification.
25 Enacting section 1. This amendatory act takes effect July
26 1, 2004.
