SUBSTITUTE FOR

HOUSE BILL NO. 4218

                                                                             A bill to amend 1976 PA 451, entitled                                             

"The revised school code,"                                                  

by amending section 1303 (MCL 380.1303), as amended by 1995                 

PA 289.                                                                     

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

1       Sec. 1303.  (1)  The Until the end of the 2003-2004 school                 

2   year, unless the board or board of directors adopts its own local           

3   policy to the contrary, the board of a school district or board             

4   of directors of a public school academy shall not permit any                

5   pupil to carry a pocket pager, electronic communication device,             

6   or other personal communication device in school except for                 

7   health or other unusual reasons approved by the board  , and or            

8   board of directors.  A board or board of directors may develop              

9   penalties that it considers appropriate for a pupil who violates            

10  this prohibition or its own policy.                                         

1   (2) Beginning with the 2004-2005 school year, subsection (1)                

2   does not apply and the board of a school district or board of               

3   directors of a public school academy may adopt and implement its            

4   own local policy concerning whether or not a pupil may carry a              

5   pocket pager, electronic communication device, or other personal            

6   communication device in school.
