SUBSTITUTE FOR
HOUSE BILL NO. 4077
A bill to amend 1980 PA 299, entitled
"Occupational code,"
by amending section 1204 (MCL 339.1204), as amended by 1997
PA 97.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 1204. (1) The department shall issue a license to a
2 person for the operation of a cosmetology establishment if all of
3 the following requirements are met:
4 (a) An application is submitted by the owners or managers of
5 the establishment.
6 (b) The application includes a drawing or diagram indicating
7 the premises to be licensed and the location of required
8 equipment and facilities.
9 (c) The premises has satisfactorily passed an inspection
10 conducted by the department for the purpose of determining
1 whether the establishment has met sanitation and equipment
2 standards prescribed in rules promulgated by the director.
3 (d) Except as provided in subsection (3), the cosmetology
4 establishment shall be under the daily attendance and supervision
5 of a licensed cosmetologist who is not less than 18 years of age
6 and has had not less than 1 year's practical experience in
7 cosmetology.
8 (2) A cosmetology establishment shall be completely separated
9 by full partitions and doors from a dwelling or a school of
10 cosmetology.
11 (3) The department may issue a limited cosmetology
12 establishment license to a person who seeks to perform only 1 or
13 more services of cosmetology on the premises. If the
14 establishment license is limited to only manicuring services or
15 skin care services, the supervising licensee may be an individual
16 licensed only in that service. A licensed cosmetologist working
17 in a limited licensed cosmetology establishment shall not perform
18 cosmetology services for which the premises are not licensed. If
19 the cosmetology establishment license is limited to electrology,
20 the supervising licensee
shall be a licensed electrologist. with
21 1 year of experience
in electrology. A licensed
cosmetologist
22 shall not supervise a cosmetology establishment whose cosmetology
23 license is limited to rendering electrology unless the
24 cosmetologist is licensed as an electrologist.
25 (4) The department may grant a temporary establishment
26 license to a person who has fulfilled all licensure requirements
27 except for the completion of the inspection.
1 (5) The transfer of ownership or location of a cosmetology
2 establishment voids the license. The filing of a new license
3 application is a predicate to the change in ownership or location
4 of an establishment.
5 (6) The license of the establishment and of each individual
6 working in the establishment shall be displayed in a prominent
7 place which is visible to the public at all times. The license
8 of an individual working in the establishment may be posted at
9 the individual's work station.
