SUBSTITUTE FOR
HOUSE BILL NO. 5121
A bill to amend 1976 PA 451, entitled
"The revised school code,"
(MCL 380.1 to 380.1852) by adding section 1240.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 1240. (1) Subject to subsections (2) and (3), the
2 board of a school district that has a membership of at least
3 20,000 pupils and that includes in its territory a city with a
4 population of at least 180,000 as of the most recent decennial
5 census may employ public safety officers or police officers and
6 may grant to the public safety officers or police officers of
7 that school district the powers and authority of a peace or law
8 enforcement officer. Public safety officers or police officers
9 granted the powers and authority under this section shall have
10 the same powers and authority of a peace officer under the code
11 of criminal procedure, 1927 PA 175, MCL 760.1 to 777.69, and as
1 provided under the Michigan vehicle code, 1949 PA 300, MCL 257.1
2 to 257.923.
3 (2) Before granting the powers and authority of a peace or
4 law enforcement officer as described in subsection (1), the board
5 of a school district shall conduct at least 2 public hearings.
6 (3) The board of a school district shall not grant the powers
7 and authority described in subsection (1) unless the board
8 creates a public safety advisory committee. The public safety
9 advisory committee shall be composed of at least 3 and not more
10 than 5 members appointed by the chief administrator of the school
11 district with the concurrence of the board of the school
12 district. The public safety advisory committee shall receive and
13 address grievances by persons against the public safety officers
14 or police officers or against the public safety department or
15 police department of that school district. The committee may
16 recommend to the board or the administration of that school
17 district that disciplinary measures be taken against a public
18 safety officer or police officer who is found responsible for
19 misconduct in office.
20 (4) Subject to subsection (5), the jurisdiction of public
21 safety officers or police officers granted powers and authority
22 of peace or law enforcement officers under this section shall
23 include all territory within the boundaries of the school
24 district and all property outside the boundaries of the school
25 district that is owned, leased, or rented by or is otherwise
26 under the legal control of the school district that employs the
27 public safety officers.
1 (5) The public safety department or police department of a
2 school district and each local law enforcement agency with which
3 it has overlapping jurisdiction shall enter into a memorandum of
4 understanding that establishes reasonable communication and
5 coordination efforts between the department and the agency.
6 (6) Public safety officers or police officers of a school
7 district to whom the powers and authority of a peace or law
8 enforcement officer are granted under this section shall meet the
9 minimum standards of the commission on law enforcement standards
10 act, 1965 PA 203, MCL 28.601 to 28.616.
11 (7) The public safety department or police department of a
12 school district shall submit monthly uniform crime reports
13 pertaining to crimes within the department's jurisdiction to the
14 department of state police in the same manner as uniform crime
15 reports are submitted under section 1 of 1968 PA 319, MCL 28.251.
