SUBSTITUTE FOR

HOUSE BILL NO. 4914

                                                                             A bill to amend 1994 PA 451, entitled                                             

"Natural resources and environmental protection act,"                       

(MCL 324.101 to 324.90106) by adding section 80124a.                        

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

1   Sec. 80124a.  (1) Subject to subsection (4), the secretary                  

2   of state shall make available for purchase an annual Great Lakes            

3   protection specialty watercraft decal.  The Great Lakes                     

4   protection specialty watercraft decal shall be designed by the              

5   secretary of state and shall depict some aspect of the Great                

6   Lakes or of Great Lakes water quality.  The secretary of state              

7   shall make the Great Lakes protection specialty watercraft decal            

8   available for purchase when a person purchases a decal under                

9   section 80124 and at other times as determined by the secretary             

10  of state.                                                                   

11      (2) The Great Lakes protection specialty watercraft decal                   

1   shall be sold for $35.00.  Money received by the secretary of               

2   state from the sale of each Great Lakes protection specialty                

3   watercraft decal shall be used as follows:                                  

4       (a) $10.00 shall be retained by the secretary of state for                  

5   use in creating and distributing the decal.                                 

6       (b) $25.00 shall be forwarded to the state treasurer for                    

7   deposit into the Michigan Great Lakes protection fund to be used            

8   for research on aquatic nuisance species, for public education of           

9   the threat of aquatic nuisance species, and for efforts to                  

10  eradicate aquatic nuisance species from the Great Lakes and other           

11  waters of the state.                                                        

12      (3) The secretary of state may establish the appropriate                    

13  placement of Great Lakes protection specialty watercraft decals             

14  on watercraft so as not to create confusion for law enforcement             

15  officers with decals required under section 80124.                          

16      (4) The secretary of state shall discontinue sales of Great                 

17  Lakes protection specialty watercraft decals under subsection (1)           

18  if the secretary of state is unable to sell at least 2,000 decals           

19  in the fiscal year ending September 30, 2005 and at least 500               

20  decals in each fiscal year thereafter.                                      

21      (5) As used in this section:                                                

22      (a) "Aquatic nuisance species" means that term as it is                     

23  defined in section 3101.                                                    

24      (b) "Michigan Great Lakes protection fund" means the Michigan               

25  Great Lakes protection fund created in section 32905.
