CONTENT
The bill would amend the fingerprinting law to extend the sunset date on the amount of the fee charged for criminal record checks of fingerprints for employee-related or licensing-related purposes. Under the existing sunset provision, the $30 fee currently established for such record checks will expire on October 1, 2004; as a result, the fee will revert to a previous level of $15. The bill would extend the sunset date to October 1, 2007, providing for continuation of the $30 fee. The bill also would amend language that required the Department of State Police to submit to the Legislature, by October 1, 2003, a report stating whether the fee of $30 is sufficient to support the actual costs of fingerprinting record checks. The bill would require the report to be submitted annually by October 1.

FISCAL IMPACT
The fees collected under this law are used in support of the operation of the Department of State Police Criminal Justice Information Center Division, the division that performs the State's fingerprint criminal record checks. Under the enrolled FY 2004-05 budget bill for the Department (House Bill 5526), $1.5 million is assumed from these fees at the $30 rate. If action is not be taken to continue the collection of the fee at the $30 level, and the fee reverts $15, then the budget for the division will be underfunded by approximately $750,000. Under the act, the fee is not allowed to exceed the actual cost of the criminal record check. As required by the act, on September 8, 2003, the Department reported to the Legislature that the average actual cost to the Department for processing a set of prints is $29.83.
