CONTENT
The bill would amend the Customer Choice and Electricity Reliability Act to require the Michigan Public Service Commission (PSC) to extend until July 1, 2004, the temporary waiver for an appliance service plan (ASP) granted in case no. U-12134 issued on February 20, 2003, subject to the conditions imposed by that order.
Public Act 141 of 2000 required the PSC to develop a code of conduct that applies to all electric utilities, and includes measures to prevent cross-subsidization, information sharing, and preferential treatment between a utility’s regulated and unregulated services. (A service is “regulated” if the PSC has the authority to set the price for the service.) In case no. U-12134, the PSC granted Consumers Energy a waiver of the requirement to separate its appliance service plan (ASP) program until December 31, 2003. Under the bill, the PSC would have to extend the waiver before that date.
The bill specifies that its enactment would not be deemed to prejudice, delay, or affect any pending legal case or legal proceeding.
