A SUMMARY OF HOUSE BILL 4709 AS INTRODUCED 5-20-03

The bill would amend the Michigan Telecommunications Act to prohibit a provider of basic local exchange service from refusing to transfer or from delaying the transfer of a basic local exchange service customer to another provider of the service.

The Michigan Public Service Commission would have 90 days from the effective date of the bill to establish by order uniform statewide standards and procedures for the timely transfer of customers between providers of basic local exchange service, including maximum time periods within which a provider would have to transfer a customer to a chosen new provider. The procedures and time periods would have to be consistent with those established by the Federal Communications Commission, if any.

Until the procedures and time periods had been established under the provisions of the bill, a basic local exchange provider would have to perform all of the operations necessary for the timely transfer of customers using the performance standards and measurements previously established by the PSC for the largest incumbent basic local exchange service provider in the state.
