A SUMMARY OF HOUSE BILL 4252 AS INTRODUCED 2-19-03

The bill would add a new section to the Worker's Disability Compensation Act to allow a person who had made a claim under this act to submit a written request to an employer, carrier, principal, or subcontractor for information relating to the claim that was in the possession of any of the named entities. The entity would have to provide the requested information, or a written statement that it did not have that information, within 30 days of receiving the request.

An entity that did not comply with this requirement would have to pay the person requesting the information $50 per day for each day after the expiration of the 30-day time period that the information or written statement was not provided. "Information" would include, but wouldn't be limited to, data, reports, and records relating to an incident or injury that underlay a claim.
