A SUMMARY OF HOUSE BILLS 4200 AND 4210 AS INTRODUCED 2-12-03 AND 2-13-03

         House Bill 4200 would amend the Michigan Vehicle Code (MCL 257.710e) to require that a child more than 4 years of age but less than 9 years of age, and weighing at least 40 pounds but not more than 80 pounds, and a child that is not more than 4 feet 9 inches in height, be seated in a manufacturer-certified booster seat and secured by a seat belt while a passenger in a motor vehicle.

         House Bill 4210 would amend the Michigan Vehicle Code (MCL 257.907) to require a court to waive any civil fine or cost against a person who received a civil infraction citation for a violation of the booster seat provision, if the person, before the appearance date on the citation, supplied the court with evidence of acquisition, purchase, or rental of a child seating system that met the requirements of the provision.

         The bills are tie-barred, meaning that neither could take effect unless both were enacted into law.  The bills would take effect April 1, 2004.
