God, we give You thanks for this day and for this hour in which we gather. We confess, O God, that the many trappings that we often find ourselves in, we find ourselves overcome by what it is that we have to do.
Lord, we pray that the agenda here might not only be our agenda, but it might be upon Your agenda. Help us to see and do what it is that You have called and placed upon the hearts of each and every person here to do. We ask for Your guidance, and we ask for Your patience as we struggle through the issues for this yet another day. Bless us with Your Spirit, and carry us on into the day, we pray. Amen.

Senate Resolution No. 158.
A resolution to honor the memory of Natalia Horak and to urge eradication of the bacterial organism Neisseria meningitidis.
Whereas, Natalia Horak, an athletic, smart, vibrant, sixteen-year-old girl, died after a brief but fatal infection of bacterial meningitis. Natalia Horak, daughter of Fritz and Lucy Horak, was a popular sophomore at Western High School in Bay City, Michigan; and
Whereas, The bacterial organism Neisseria meningitidis can and does cause the serious diseases of meningococcal meningitis and menigococcemia; and
Whereas, Meningococcal meningitis and menigococcemia can often be successfully treated with appropriate antibiotics and supportive in-hospital care, but sometimes are very aggressive and fatal in spite of timely medical interventions; and
Whereas, The currently available meningococcal vaccine does not protect against disease from all major subtypes of Neisseria meningitidis, provides only several years of incomplete immunity for some of the major subtypes of Neisseria meningitidis, and is not approved for use in the youngest children who have the highest rates of invasive Neisseria meningitidis disease; and
Whereas, Other bacterial pathogens (such as Haemophilus influenzae type b and Streptococcus pneumoniae) which can cause meningitis and blood stream infections are being controlled with widely used vaccines for infants and toddlers; and
Whereas, Efforts are underway to develop more effective vaccines to provide long-lasting immunity against diseases caused by Neisseria meningitidis, as well as vaccines that could be administered in infancy; now, therefore, be it
Resolved by the Senate, That we hereby honor the memory of Natalia Horak; and be it further
Resolved, That this legislative body calls upon agencies of the federal Department of Health and Human Services, vaccine researchers, and vaccine manufacturers to redouble efforts at developing and making widely available more effective vaccines to protect against diseases caused by Neisseria meningitidis so that the burdens of these serious diseases can be significantly reduced, if not eliminated; and be it further
Resolved, That a copy of this resolution be transmitted to the U.S. Department of Health and Human Services, the United States Senate Committee on Health, and the House of Representatives Committee on Health in Washington, D.C.

Senate Resolution No. 159.
A resolution to establish a task force to study the costs and benefits of a Medicaid buy-in program for working people with disabilities.
Whereas, Current Medicaid policies force many people with disabilities who would otherwise work to remain in poverty in order to qualify for Medicaid and receive essential medical care. This problem is compounded by the fact that many employers do not provide group health insurance. For people with disabilities, privately purchased insurance is not available in many instances at any price; and
Whereas, One concept that has been suggested is a buy-in program to permit people with disabilities who return to work to purchase Medicaid coverage from the state by paying premiums on a sliding scale related to income. Such an idea would seem to offer a farsighted approach to helping people with disabilities gain greater self-sufficiency. A buy-in option to preserve health services would encourage people to work, which ultimately should reduce Medicaid dependency; and
Whereas, Every effort should be made to remove barriers to meaningful employment. The MI Job Coalition surveyed people with disabilities and found that loss of health care is the major detriment to obtaining employment; and
Whereas, States have the option under federal law to provide a buy-in program. Some states have successfully implemented such programs. Michigan would be well served to examine this possibility fully; now, therefore, be it
Resolved by the Senate, That there be created a task force to study the costs and benefits of a Medicaid buy-in program for people with disabilities. The task force shall include legislators; representatives of the Senate Fiscal Agency, the Michigan Commission on Disability Concerns, the Department of Community Health, the Department of Career Development, the Department of Management and Budget, the MI Job Coalition, and the Benefits Planning, Assistance and Outreach Program; employers in Michigan; and workers with disabilities. Meetings for the task force will be subject to the state's Open Meetings Act, 1976 PA 267, including prior notice provisions; and be it further
Resolved, That the task force shall assess the potential contributions of more working citizens to the state economy, review alternative program designs and associated costs, and review the relevant experience of other states. The task force shall report its findings and recommendations to the Michigan Legislature by February 28, 2002.

House Concurrent Resolution No. 55.
A concurrent resolution to urge the United States Forest Service to conduct or authorize an on-site excavation and testing to determine if illegal dumping of hazardous material took place at the former Raco missile site in the Hiawatha National Forest in Chippewa County.
Whereas, In the late 1970s, the Raco missile site in the Hiawatha National Forest in Chippewa County was decommissioned; and
Whereas, This site, which housed conventional ground-to-air missiles, runways, and other facilities, was the scene of several cleanups in the years following the decommissioning. Area residents, however, have long questioned the thoroughness of cleanup efforts. Of particular concern is what happened to nearly 44,000 gallons of highly toxic, lead-contaminated fuel sludge discovered in fuel tanks by one of the companies contracted to help clean up the area. One of the individuals who worked on the cleanup, who is a local official in the area now, claims firsthand knowledge of an incident that indicates that the waste may have been dumped illegally; and
Whereas, Township boards in the area have asked the United States Forest Service to permit an exploratory examination of the site where the materials may have been dumped. A private group has agreed to pay for the excavation in order to see if the 44,000 gallons of fuel sludge were dumped and have damaged the soil and water at the site; and
Whereas, The people of the Chippewa County area clearly have the right to know if harmful materials are buried in the community. An excavation of the specific site can be undertaken quickly and can provide information of great value. Clearly, this is a reasonable request when measured against the potential damage that may have been done to the site; now, therefore, be it
Resolved by the House of Representatives (the Senate concurring), That we urge the United States Forest Service to conduct or authorize an on-site excavation and testing to determine if illegal dumping of hazardous material took place at the former Raco missile site in the Hiawatha National Forest in Chippewa County; and be it further
Resolved, That copies of this resolution be transmitted to the United States Forest Service.

Senator Shugars' statement is as follows:
I rise to let my colleagues and staff know that we're doing our twelfth year of senior staff workshops, and a number of seniors came in to have their prescription drug credit prepared. As you all know, the EPIC program was started at the end of last year. We are finding that a number of those individuals who will qualify for EPIC did not file the application and the $25 application fee. In one particular case, there was a lady who spent over $2,400 last year for prescription medications, and she will qualify for EPIC, but she just got it in the mail and didn't look at it. So we helped her fill it out, and she will qualify. It will save her--compared to this year's--almost $1,700.
So the reason I am saying that is there are a lot of senior citizens in Michigan, and there are a lot of our constituents who are not fully aware of EPIC who qualified either for the emergency prescription service or the prescription drug credit.
So if you come across them in your district, make sure any senior who gets a prescription tax credit this year, make sure that they have applied for EPIC because it is very, very important, and it can be a material amount of dollars. I just want to make sure that my colleagues and anybody who is watching MGTV make sure that they check into it.
Senator Byrum's statement is as follows:
Since the good Senator from the 21st District opened up the discussion of EPIC, I would like to alert my colleagues to the fact that there is going to be no expansion of the EPIC program beyond those who had qualified for the emergency program or the tax credit; as we were given the impression during the budget process--even though appropriated money.
Those seniors who are at 200 percent of poverty are not going to be afforded the opportunity to even apply for the EPIC program. As of yesterday, the department had no intention of opening that program, and there are not even applications available for any citizens in this great state who's at that 200 percent of poverty to even be able to apply.
So, very clearly, we have missed the mark, and we have fallen way short of our health for seniors and to cover their cost of prescription drugs.
