Protest
Senator Smith, under her constitutional right of protest (Art. 4, Sec. 18), protested against the passage of House Bill No. 5091.
Senator Smith's statement is as follows:
The purpose of the legislation was to ostensibly reduce the opportunity for violence and terrorism, and it's a response to the events of September 11. I think it serves to do neither. In the public school systems where we have so many different religious denominations and so few, but still there and present, young people who don't believe in any God, to create a religious belief through the use of the national motto in a public school system, I think, is inappropriate. It does nothing to diminish violence. It does nothing to promote worship.
I attended a Catholic school for 12 years, and I think some of the least respectful and least thoughtful time we spent in school was when we said our prayer or went to mass in the morning. And based on that experience, I think that this is no solution to anything, and I voted "no."

Protest
Senator Peters, under his constitutional right of protest (Art. 4, Sec. 18), protested against the passage of Senate Bill No. 486 and moved that the statements he made during the discussion of the bill be printed as his reasons for voting "no."

Senator Peters' first statement is as follows:
I would like to encourage folks to vote "no" on the bill. Quite straightforward, I think this is an anti-small business bill as it is written right now. Basically, the intention in the past was to tax franchisors, and that was changed in a court ruling. What the bill is going to do as a result of that is go back and charge franchisees--these are the small mom and pop's that own a franchise--with the tax. And it's not just gonna be a tax for just recent tax but for the last four years. They're going to be hit with a retroactive tax when all along they were being told by the Treasury Department that the tax liability was not on them; they did not have to pay the tax; the franchisor would pay the tax.
It was later ruled that the frachisor wouldn't pay the tax; the franchisee should do it. And now the state of Michigan is going back to all of those mom and pop franchisees and saying, "You owe us taxes even though we've told you for the last four years you didn't have to pay it. You're gonna have to pay four years' worth of taxes. And guess what? We're gonna charge you interest as well on that."
Now I believe that we may change the law going forward, but we need to clarify it so everybody knows what sort of tax liability they are responsible for. But it's unconscionable to go back to small businesses and say to them, "Even though we told you you didn't have to pay this tax in the past, now you have to, and you have to pay us interest on that." I do not believe in retroactive taxation. This is an anti-small business bill, and I'll be voting "no" and urge other members to as well.
Senator Peters' second statement is as follows:
Let's be clear--we can help those small businesses moving forward. We can change this bill to do that--moving forward and helping them. But it is certainly disingenuous to say we are going to help you by charging you for the last four years of taxes, plus we're going to charge you interest. I mean, the treasury may think that's a good deal for them, but it's certainly not a good deal for small businesses. It's not a good deal for franchisees. We can do this bill right--change it going forward. You do not have to have the retroactive feature. By voting for this bill, you are having retroactive taxation with interest against small businesses, and that's anti-small business. I don't know how you can look at it any other way. I would urge a "no" vote.
Senator Peters' third statement is as follows:
I don't want to belabor this issue, but it is true we can fix this bill going forward. We can fix it for this year, and we can fix it going forward. This bill goes beyond that, and I hope that everyone realizes that this is retroactive taxation. It does not need to be part of this bill, but it is still part of this bill. I will stand up here and say over and over again I will never vote in favor of retroactive taxation with interest. I think that is wrong. It's anticompetitive; it's anti-small business. I would urge a "no" vote.

Senator Leland's statement is as follows:
Mr. President and members, I will be voting "no" on this bill. I believe that this is the wrong time to require welfare recipients to work 40 hours a week. We are in a decline--a shrinking economy. We are officially in a recession. The unemployment in this state and around the country has risen in the last few months.
I have a couple statistics that I'm just going to mention to you before final passage. The research seminar in quantitative economics at the University of Michigan is forecasting a decline of 1.8 percent in Michigan wage and salary employment for the first quarter of 2002, followed by another .3 percent decline in the second quarter. The recovery forecast for the third and fourth quarters will not be large enough to prevent the state from having a net decline in wage and salary employment for 2002. The research seminar in quantitative economics forecasts or predicts the net decline of .6 percent for the year, translating into 28,900 jobs.
I feel that, again, this is the wrong time to require our welfare recipients to find 40 hours of employment. It just may not be out there. I think it's mean-spirited and punitive. I hope that this chamber would vote against it.
Senator Smith's statement is as follows:
I rise to talk about two issues: one, the legislation itself and the content that is not there, and that's the content that Senator Scott addressed. The issue is that it really does not make an improvement and opportunities for people of low income, particularly when we are facing very tough economic times. One of the things that appears to be causal relation to this introduction and rush to pass this bill is we see it as a way of saving dollars in the Family Independence Agency. We can use provisions in this bill to make sure that individuals are, in fact, denied benefits more frequently, that they are found not to be in compliance more easily, and that they then lose their subsidy and their support.
The other thing is the process. This bill left committee yesterday, and it was forced through this floor in a matter of hours. It would have been quicker if the Republicans hadn't wanted to caucus. The need for a close review and a close scrutiny as indicated by the fact that, oh, changes are going to be made in the House that have been agreed to among lobbyists and interest groups. I think it is very good that people are actually working hard to get changes in this bill, and I applaud them for it. But the Senators in this chamber have a responsibility to our constituents. That responsibility has been abridged by the process that has been adopted, and our concern that if we are too vocal on our side, the compromises that have been agreed to may fall.
I urge my colleagues to vote "no" on this legislation. It has more need for amendment than those compromises that have been agreed to. The bottom line in the state should not be how we save money in the department and in the General Fund budget or in the federal funding that comes through, but how we save families and children and the neighborhoods in which they live.
Senator Scott's statement, in which Senator Hart concurred, is as follows:
This bill places family and child well-being at risk. The only people who even testified in favor of this bill were the Family Independence Agency, who has apparently already printed up policy and notices that reflect the changes in this bill, and the association that represents FIA county directors.
The potential negative impacts of this bill are too great to not listen to advocates who have voiced opposition. These bills will undoubtedly have some families falling through the cracks. These cracks will end up forcing victims of domestic violence to go back to their batterers.
This bill removes the safety net for families who need to care for their children who have severe health problems or disabilities. Studies have shown the biggest barrier to self-sufficiency for these families is safe, high-skilled, accessible and fully subsidized child care.
This bill does not ensure access to safe, quality child care or even ensure training will be available if work is not. If we are going to make families successful, we need to provide the resources. Placing child well-being in danger is not the answer. I urge you to vote "no."

Whereas, In the weeks since the terrorist attacks of September 11, 2001, our country has witnessed a rebirth of patriotism. As has been the case in other times of national trial, the people of this country are drawing strength from renewing our commitment to our fellow citizens and neighbors and to the wonderful ideals that set the United States apart from every other country as the world's oldest democracy; and
Whereas, The Pledge of Allegiance has served for generations as a brief, but powerful, declaration of dedication to our republic and to one another. This simple statement nurtures the spirit of unity of purpose that is vital to our common future as Americans. Regardless of a person's background or beliefs, the Pledge of Allegiance can be an important reminder of our shared democratic values; and
Whereas, While many classrooms and governmental bodies do regularly begin classes or meetings with the Pledge of Allegiance, this is something that should be strongly encouraged throughout our state. The recitation of this statement can serve as a focal point to foster unity and to remind each of us that, no matter what our ethnic, religious, or family background and no matter what our economic status, profession, or ideas, we have a commitment to one another and to ideals that are timeless. To pause to say the Pledge of Allegiance is certainly an appropriate activity for citizens of all ages; now, therefore, be it
Resolved by the Senate, That we urge local units of government and the state's public schools and public school academies to recite the Pledge of Allegiance each day or meeting.
