Dear Heavenly Father, we come to You this day saying thank You. Thank You for this wonderful, blessed day. Thank You, Lord, for the opportunity to serve in this great state--Your people, Lord.
Heavenly Father, we just say thank You for all the many blessings that you bestow upon us each and every day. Thank You for our families, Lord; thank You for our friends.
Father, we just say thank You for the men and women who serve in this great State Senate, Lord. We thank You for all the legislators all over this state. A bill to amend 1978 PA 368, entitled "Public health code," (MCL 333.1101 to 333.25211) by adding section 16277.

Senate Bill No. 498, entitled
A bill to amend 1927 PA 175, entitled "The code of criminal procedure," by amending section 16m of chapter XVII (MCL 777.16m), as amended by 2000 PA 279.
The House of Representatives has amended the bill as follows:
1. Amend page 3, line 6, by striking out "750.237(2)" and inserting "750.237(3)".
2. Amend page 3, line 10, by striking out "750.237(3)" and inserting "750.237(4)".
3. Amend page 3, following line 12, by inserting:
"Enacting section 1. This amendatory act takes effect February 1, 2002." and renumbering the remaining enacting section.
The House of Representatives has passed the bill as amended, ordered that it be given immediate effect and pursuant to Joint Rule 20, inserted the full title.
Pursuant to rule 3.202, the bill was laid over one day.
House Bill No. 4481, entitled
A bill to amend 1967 PA 281, entitled "An act to meet deficiencies in state funds by providing for the imposition, levy, computation, collection, assessment, and enforcement by lien and otherwise of taxes on or measured by net income; to prescribe the manner and time of making reports and paying the taxes, and the functions of public officers and others as to the taxes; to permit the inspection of the records of taxpayers; to provide for interest and penalties on unpaid taxes; to provide exemptions, credits and refunds of the taxes; to prescribe penalties for the violation of this act; to provide an appropriation; and to repeal certain acts and parts of acts," by amending section 527a (MCL 206.527a), as amended by 1996 PA 484.
The House of Representatives has amended the Senate substitute (S-2) as follows:
1. Amend page 15, following line 5, by inserting:
"(22) THE STATE TREASURER SHALL NOTIFY ALL OF THE FOLLOWING EACH STATE FISCAL YEAR THAT THE FEDERAL LOW INCOME HOME ENERGY ASSISTANCE PROGRAM BLOCK GRANT ALLOTMENT FOR THIS STATE FOR THAT FISCAL YEAR IS LESS THAN THE FULL HOME HEATING CREDIT AMOUNT:
(A) THE CHAIRPERSONS AND VICE-CHAIRPERSONS OF THE SENATE AND HOUSE OF REPRESENTATIVES APPROPRIATIONS COMMITTEES.
(B) THE SENATE AND HOUSE OF REPRESENTATIVES COMMITTEES ON TAXATION AND FINANCE RELATED ISSUES.
(C) THE SENATE AND HOUSE OF REPRESENTATIVES COMMITTEES ON ENERGY AND TECHNOLOGY RELATED ISSUES." and renumbering the remaining subsections.
The House of Representatives has concurred in the Senate substitute (S-2) as amended and agreed to the full title.

Senate Resolution No. 129.
A resolution commemorating Bronson Methodist Hospital as the recipient of the 2001 Quality Leadership Award.
Whereas, Michigan hospitals provide excellent health care for patients from across the Great Lakes State and across the country. Our facilities contribute to their communities by providing thousands of jobs, supporting local charities, and promoting wellness; and
Whereas, Bronson Methodist Hospital in Kalamazoo is a major medical center with 348 licensed beds, providing care in virtually every medical specialty. Bronson serves as a regional referral center for southwest Michigan and northern Indiana; and
Whereas, Bronson completed a $181 million redevelopment of its campus in 2000, receiving numerous awards for its design and healing environment. In 2001, Bronson was named by Modern Maturity magazine as one of the top 15 "Hospitals with Heart" in the United States for leadership in patient-centered care; and
Whereas, Bronson Methodist Hospital will receive the 2001 Quality Leadership Award, the state's highest award for outstanding quality and customer service, from the Michigan Quality Council on November 8, 2001. The Michigan Quality Council was created in 1983 by business leaders and is supported by Governor John Engler to promote Total Quality Management practices in business, educational institutions, and organizations throughout Michigan; now, therefore, be it
Resolved by the Senate, That tribute be accorded to Bronson Methodist Hospital and all of its employees, medical staff, and volunteers in recognition of their achievement in continuous quality improvement and clinical and service excellence symbolized by Bronson's receipt of the 2001 Quality Leadership Award; and be it further
Resolved, That a copy of this resolution be transmitted to Bronson Methodist Hospital as evidence of our best wishes.
Senator Goschka was named co-sponsor of the resolution.

A resolution commemorating the contributions of Michigan veterans to preserving American freedoms.
Whereas, Throughout the course of American history, courageous men and women have taken up arms to secure, defend, and maintain the principles on which our nation's freedoms depend; and
Whereas, Terrorists ruthlessly attacked our land and our freedoms. Their attempt to assail the American spirit failed, and our nation's response reveals the spirit of freedom is as strong as ever. American troops are now fighting overseas to defeat terrorism, following in the footsteps of the 48 million men and women who have stepped forward to defend our land since our nation's founding; and
Whereas, There are more than 25 million living veterans who served our nation in times of peace and war. These veterans have diverse religious beliefs and come from varying backgrounds and ethnicities. Through their service, they kept America strong, and they have protected our way of life from tyranny's grip for over two centuries. At this moment, men and women from Michigan are serving in the Army, Navy, Air Force, Marines, and Coast Guard around the world. They represent our resolute dedication to achieving a lasting peace out of the challenges and threats of the 21st century; and
Whereas, Veterans Day is a time to pause and reflect on the sacrifices of all those who have served in the United States military. Let us especially honor our veterans from Michigan, who have proved their heroism and love of country again and again--from Gettysburg to Iwo Jima, from the Chosin Reservoir to the Persian Gulf. They defended our ideals across the globe, and they continue to inspire those who defend America today half a world away; and
Whereas, More than a million American men and women have died in service to America, and more than a million and a half have been wounded. Some sustained serious injuries in combat and now live with disabilities. The nation will always be grateful for the noble sacrifices of our veterans; now, therefore, be it
Resolved by the Senate, That tribute be accorded to all Michigan veterans who have served in the United States military for their sacrifices in demonstrating the timeless truth that freedom is not free. We urge all Michigan citizens to recognize the valor and sacrifice of our veterans through appropriate public ceremonies and private prayers; and be it further
Resolved, That copies of this resolution be transmitted to Michigan veterans, their families, and service organizations as a token of our appreciation for their service.

A concurrent resolution to memorialize Congress to support the efforts of World War II American POWs seeking restitution and apologies from Japan.
Whereas, Even amid the incalculable suffering and death of World War II, the horrors that faced Americans imprisoned by the Japanese stand out as atrocities that were truly inhuman. The Americans who surrendered in the Bataan Peninsula after a hopeless five months of fighting experienced a degree of depravity in their treatment that is difficult to comprehend. The murder, torture, and cruelty of the Bataan Death March and the subsequent imprisonment were followed by the brutalities of forced labor in factories and mines operated by several prominent Japanese corporations; and
Whereas, Efforts by the survivors of Japanese prisons and forced labor to seek restitution and a modicum of justice have been thwarted all these years by provisions of the treaty between the United States and Japan that ended the war. The clear and repeated violations of the Geneva Convention and human decency that took place in captivity under the Japanese have been shielded by treaty provisions that waived future claims. However, the treaty apparently also provided that restitutions could be sought if other nations received them. Reportedly, eleven nations have agreed to some type of terms; and
Whereas, Beyond the clear illegalities of forced labor on behalf of companies and the nation of Japan, there are moral issues that clearly cry out for resolution. The ever-decreasing number of survivors of these horrors certainly deserve justice, however delayed it may be; and
Whereas, There is a bill pending in Congress, H.R. 1198, that would help these POWs in their court actions seeking compensation and formal apologies. Clearly, action to help these heroes is long overdue; now, therefore, be it
Resolved by the Senate (the House of Representatives concurring), That we memorialize Congress to support the efforts of World War II American POWs seeking restitution and apologies from Japan; and be it further
Resolved, That copies of this resolution be transmitted to the President of the United States Senate, the Speaker of the United States House of Representatives, and the members of the Michigan congressional delegation.

Families and friends of those lost in war endure years and decades of the unique pain of not knowing a loved one's fate, which makes healing or any sense of peace almost impossible to know; and
Whereas, The protracted and complex American military involvement in southeast Asia resulted in a large number of personnel reported missing in action. While considerable progress has been made in resolving many of these cases and in returning remains where possible, there are still hundreds--perhaps nearly 2,000--Americans unaccounted for in Vietnam, Cambodia, Laos, and nearby countries; and
Whereas, Just as these patriots made a commitment to serve our nation, our country has a moral commitment to work to find and return home America's MIAs. Our nation cannot abandon the men and women who have served us overseas during times of conflict. Carrying out the work of accounting for each person is important not only to the families of these individuals, but also to the citizens of our country today. This work is especially significant for our young people, who must learn and never forget the high price of our liberty and the true meaning of loyalty to our ideals and to one another; now, therefore, be it
