House Resolution No. 140.
A resolution to memorialize the Congress of the United States to enact legislation to provide more flexibility to refineries making the transition to reformulated gasoline fuels for use during the summer months.
Whereas, Unstable fuel prices bring many hardships to businesses, individuals, and the entire economy. Last summer's spike in gasoline costs, which was made more severe by a gasoline pipeline accident, generated great concern. The price rise also focused attention on the negative impact of federal government policies. The experience of the summer of 2000 showed the harm to pump prices caused by the change to reformulated gasoline used during the summer months; and
Whereas, Certain areas of the country must use reformulated gasoline in the summer. Switching refinery operations to these reformulated gasoline fuels takes longer than it has in the past. Because two of the largest markets in this region, Milwaukee and Chicago, must use the reformulated fuels, the fuel production for the entire Midwest region of the country is affected. The length and severity of the winter of 2000-2001 in the Midwest has already delayed the transition period that refineries need to make the switch between producing winter fuel oil to the larger volume of gasoline needed for the higher demands of the summer season; and
Whereas, There are approximately 15 different formulas for gasoline that are produced throughout the country in response to EPA mandates. The large variety of formulas make the Midwest particularly susceptible to energy supply shocks. Michigan, because of its location, is hardest hit by low gasoline supply; and
Whereas, Because of the shortage of gasoline, especially at the beginning of the summer, all possible means of reducing costs should be explored. Certainly, greater flexibility for the process of shifting to reformulated gasoline in the summer months would bring a measure of relief. A few weeks difference in the transition would be a reasonable and effective step to take; now, therefore, be it
Resolved by the House of Representatives, That we memorialize the Congress of the United States to enact legislation to provide more flexibility to refineries making the transition to reformulated gasoline fuels for use during the summer months; and be it further
Resolved, That copies of this resolution be transmitted to the President of the United States Senate, the Speaker of the United States House of Representatives, and the members of the Michigan congressional delegation.
The resolution was referred to the Committee on Transportation.

With the recommendation that the following amendments be adopted and that the bill then pass.
1. Amend page 11, line 23, by striking out all of subdivisions (A), (B), and (C) and inserting:
"(A) PAYMENT OF THE MANIFEST PROCESSING USER CHARGE AND AN ADMINISTRATIVE FINE OF 5% PER MONTH OF THE AMOUNT OWED FOR EACH MONTH THAT THE PAYMENT IS DELINQUENT. HOWEVER, THE ADMINISTRATIVE FINE SHALL NOT EXCEED 25% OF THE TOTAL AMOUNT OWED.
(B) BEGINNING 9 MONTHS AFTER THE DATE PAYMENT OF THE MANIFEST USER CHARGE IS DUE, BUT NOT PAID, AT THE REQUEST OF THE DEPARTMENT, AN ACTION BY THE ATTORNEY GENERAL FOR THE COLLECTION OF THE AMOUNT OWED UNDER SUBDIVISION (A) AND THE ACTUAL COST TO THE DEPARTMENT IN ATTEMPTING TO COLLECT THE AMOUNT OWED UNDER SUBDIVISION (A).".
2. Amend page 22, following line 9, by inserting:
"(xii) A LIQUID THAT IS NOT REGULATED UNDER PART 615 THAT IS GENERATED IN THE DRILLING, OPERATION, MAINTENANCE, OR CLOSURE OF A WELL, OR OTHER DRILLING OPERATION, INCLUDING THE INSTALLATION OF CATHODIC PROTECTION OR DIRECTIONAL DRILLING, IF EITHER OF THE FOLLOWING APPLIES:
(A) THE LIQUID IS LEFT IN PLACE AT THE POINT OF GENERATION IN COMPLIANCE WITH PART 31, 201, OR 213.
(B) THE LIQUID IS TRANSPORTED OFF-SITE FROM A LOCATION THAT IS NOT A KNOWN FACILITY AS DEFINED IN SECTION 20101, AND ALL OF THE FOLLOWING OCCUR:
(i) THE DISPOSAL COMPLIES WITH APPLICABLE PROVISIONS OF PART 31 OR 115.
(ii) THE DISPOSAL IS NOT TO A SURFACE WATER.
(iii) THE LAND OWNER OF THE DISPOSAL SITE HAS AUTHORIZED THE DISPOSAL.".
