A bill to amend 1927 PA 175, entitled

"The code of criminal procedure,"

(MCL 760.1 to 777.69) by adding section 4b to chapter IV.

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

1 CHAPTER IV

2 SEC. 4B. (1) THE DEPARTMENT SHALL ESTABLISH A FUGITIVE

3 TRANSPORT ASSESSMENT FUND PROGRAM.

4 (2) INFORMATION AND APPLICATIONS FOR GRANTS UNDER THIS SEC-

5 TION SHALL BE DISTRIBUTED UPON REQUEST BY THE DEPARTMENT. AN

6 APPLICATION FOR A GRANT UNDER THIS SECTION SHALL BE ON A FORM

7 PROVIDED BY THE DEPARTMENT AND SHALL CONTAIN INFORMATION REQUIRED

8 BY THE DIRECTOR.

9 (3) REGIONAL FUGITIVE TRANSPORTATION TEAMS AND REGIONAL

10 FUGITIVE TRANSPORTATION AGENCIES MAY APPLY FOR A GRANT UNDER THIS

11 SECTION. THE DIRECTOR SHALL AWARD MATCHING GRANTS TO REGIONAL

1 FUGITIVE TRANSPORTATION TEAMS AND REGIONAL FUGITIVE TRANSPORT

2 AGENCIES THAT ARE ENGAGED IN RETRIEVAL AND TRANSPORT UNDER SEC-

3 TION 4 OF THIS CHAPTER. A MATCHING GRANT UNDER THIS SECTION

4 SHALL PROVIDE OR REIMBURSE 75% OF THE COST OF RETRIEVAL AND

5 TRANSPORT FOR EVERY 25% OF THAT COST THAT IS PAID OR BORNE BY THE

6 COUNTY OR LOCAL UNIT OF GOVERNMENT THAT ENTERED THE ARREST WAR-

7 RANT INTO THE L.E.I.N. AS DESCRIBED UNDER SECTION 4 OF THIS

8 CHAPTER.

9 (4) THE DIRECTOR SHALL NOT AWARD A MATCHING GRANT UNDER THIS

10 SECTION TO MORE THAN 1 REGIONAL FUGITIVE TRANSPORTATION AGENCY OR

11 REGIONAL FUGITIVE TRANSPORTATION TEAM LOCATED WITHIN THE SAME

12 COUNTY.

13 (5) THE DIRECTOR SHALL PAY $500.00 TO A LAW ENFORCEMENT

14 AGENCY THAT LOCATES AND ARRESTS A PERSON FROM A COUNTY OTHER THAN

15 THE COUNTY IN WHICH THAT LAW ENFORCEMENT AGENCY IS LOCATED.

16 (6) THERE IS APPROPRIATED $5,000,000.00 TO THE FUGITIVE

17 TRANSPORTATION ASSESSMENT FUND FOR THE PURPOSE OF AWARDING MATCH-

18 ING GRANTS AND OTHER COSTS DESCRIBED UNDER THIS SECTION AND

19 SECTION 4A OF THIS CHAPTER.

20 (7) NOT LATER THAN JANUARY 1, 2005, THE DEPARTMENT OF STATE

21 POLICE SHALL REPORT TO THE HOUSE AND SENATE COMMITTEES RELATED TO

22 LAW ENFORCEMENT ISSUES ASSESSING THE EFFECT OF THIS SECTION AND

23 SECTIONS 4 AND 4A OF THIS CHAPTER ON THE REDUCTION, IF ANY, OF

24 THE NUMBER OF STATE FUGITIVES.

25 (8) AS USED IN THIS SECTION:

26 (A) "DEPARTMENT" MEANS THE DEPARTMENT OF STATE POLICE.

1 (B) "DIRECTOR" MEANS THE DIRECTOR OF THE STATE POLICE

2 APPOINTED UNDER SECTION 2 OF 1935 PA 59, MCL 28.2.

3 (C) "LAW ENFORCEMENT AGENCY" MEANS THE DEPARTMENT, A POLICE

4 AGENCY OF A CITY, VILLAGE, OR TOWNSHIP OF THIS STATE, OR A

5 SHERIFF'S DEPARTMENT OF A COUNTY OF THIS STATE.

6 (D) "REGIONAL FUGITIVE TRANSPORTATION AGENCY" MEANS A LAW

7 ENFORCEMENT AGENCY THAT SERVES A CITY WITH A POPULATION OF NOT

8 LESS THAN 750,000 AND THAT TRANSPORTS PEOPLE ARRESTED AS

9 DESCRIBED IN SECTION 4 OF THIS CHAPTER.

10 (E) "REGIONAL FUGITIVE TRANSPORTATION TEAM" MEANS 2 OR MORE

11 LAW ENFORCEMENT AGENCIES THAT SERVE A CONTIGUOUS AREA AND THAT

12 ENTERED INTO A WRITTEN COOPERATIVE AGREEMENT TO TRANSPORT PEOPLE

13 ARRESTED AS DESCRIBED IN SECTION 4 OF THIS CHAPTER.

14 Enacting section 1. This amendatory act does not take

15 effect unless all of the following bills of the 91st Legislature

16 are enacted into law:

17 (a) Senate Bill No. 1363.

21 (c) Senate Bill No. 1366.
