A bill to amend 1949 PA 300, entitled

"Michigan vehicle code,"

by amending section 733 (MCL 257.733), as amended by 1994 PA 50.

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

1 Sec. 733. (1) The department shall not release information

2 relating to an accident on the record of a driver to a nongovern-

3 mental agency unless the driver was subsequently convicted of or

4 determined responsible for a violation of this act in connection

5 with the accident. HOWEVER, THE DEPARTMENT SHALL RELEASE INFOR-

6 MATION UPON INQUIRY BY AN EMPLOYER RELATING TO AN ACCIDENT ON THE

7 RECORD OF A PROSPECTIVE EMPLOYEE IF THE EMPLOYEE IS APPLYING FOR

8 EMPLOYMENT THAT REQUIRES A COMMERCIAL DRIVER LICENSE.

9 (2) The department shall not release information relating to

10 an accident on the record of a police officer, fire fighter, or a

11 person authorized to operate an ambulance or other emergency

1 vehicle to a nongovernmental agency if the accident occurred

2 while the person was operating the vehicle during the course of

3 his or her employment.
