A bill to amend 1982 PA 415, entitled "Correctional officers' training act of 1982," by amending sections 2, 3, 4, 5, 14, and 15 (MCL 791.502, 791.503, 791.504, 791.505, 791.514, and 791.515). THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 2. As used in this act: 2 (a) "Central training academy" means the central training 3 academy established pursuant to section 15. 4 (b) "Correctional facility" means either of the following: 5 (i) A A facility or institution which houses an inmate popula- 6 tion under the jurisdiction of the department of corrections. 7 (ii) A municipal or county jail, work camp, lockup, holding 8 center, halfway house, community corrections center, or any other 9 facility maintained by a municipality or county which houses 10 adult prisoners. H04778'01 c * DRM 2 1 (c) "Council" means the correctional officers' training 2 council created under section 3. 3 (d) "Department" means the state department of corrections. 4 (e) "Executive secretary" means the executive secretary of 5 the council. 6 (f) "Local correctional officer" means any person employed 7 by a unit of local government in a correctional facility as a 8 correctional officer, or that person's immediate supervisor. 9 (g) "State correctional officer" means any person employed 10 by the department in a correctional facility as a correctional 11 officer or a corrections medical aide, or that person's immediate 12 supervisor. 13 Sec. 3. The correctional officer's training council is cre- 14 ated within the department and shall establish standards regard- 15 ing training and education as prescribed in this act. The coun- 16 cil shall consist of 10 11 members appointed by the governor. 17 The members shall be appointed as follows: 18 (a) One member shall represent state corrections officers. 19 (b) One member 2 MEMBERS shall represent local correc- 20 tions officers DEPUTY SHERIFFS IN THIS STATE AND SHALL BE MEM- 21 BERS OF THE DEPUTY SHERIFFS ASSOCIATION. 22 (c) One member shall represent local agencies which main- 23 tain jails, corrections, or temporary holding facilities 24 SHERIFFS IN THIS STATE AND SHALL BE MEMBERS OF THE MICHIGAN SHER- 25 IFFS ASSOCIATION. 26 (d) One member shall represent the Michigan commission of 27 corrections DEPARTMENT. H04778'01 c * 3 1 (e) One member shall represent the office of criminal 2 justice DEPARTMENT OF MANAGEMENT AND BUDGET. 3 (f) One member shall represent the state personnel 4 director. 5 (g) Two members shall represent the public at large. 6 (h) Two members shall represent the academic community, at 7 least 1 of whom shall represent Michigan community colleges. 8 Sec. 4. (1) All members of the council shall hold office 9 for a term of 3 years. , except that of the members first 10 appointed 3 shall have a term of 1 year, 4 shall have a term of 11 2 years, and 3 shall have a term of 3 years. Successors shall be 12 appointed in the same manner as the original appointment. 13 (2) A person appointed as a member to fill a vacancy created 14 other than by expiration of a term shall be appointed in the same 15 manner as the original appointment for the remainder of the unex- 16 pired term of the member whom the person is to succeed. 17 (3) Any member may be reappointed for additional terms. 18 Sec. 5. (1) The council shall designate from among its mem- 19 bers a chairperson and a vice-chairperson who shall serve for 20 1-year terms and who may be reelected. 21 (2) The council shall meet at least 4 times in each year at 22 Lansing. The council shall hold special meetings when called by 23 the chairperson or, in the absence of the chairperson, by the 24 vice-chairperson, or when called by the chairperson upon the 25 written request of 5 6 members of the council. The council 26 shall establish its own procedures and requirements with respect 27 to quorum, place, and conduct of its meeting and other matters. H04778'01 c * 4 1 (3) The business which the council may perform shall be 2 conducted at a public meeting of the council held in compliance 3 with the open meetings act, Act No. 267 of the Public Acts of 4 1976, as amended, being sections 15.261 to 15.275 of the Michigan 5 Compiled Laws 1976 PA 267, MCL 15.261 TO 15.275. Public notice 6 of the time, date, and place of the meeting shall be given in the 7 manner required by Act No. 267 of the Public Acts of 1976, as 8 amended THE OPEN MEETINGS ACT, 1976 PA 267, MCL 15.261 TO 9 15.275. 10 (4) The members of the council shall serve without compensa- 11 tion but shall be entitled to their actual expenses in attending 12 meetings and in the performance of their duties under this act. 13 Sec. 14. Not later than 3 years after the effective date 14 of this act, the THE council shall develop minimum standards 15 and requirements for PERFORM DUTIES RELATING TO THE certifica- 16 tion, recertification, and decertification of local correctional 17 officers AND THE OPERATION OF THE LOCAL CORRECTIONS OFFICERS 18 ADVISORY COUNCIL, AS PRESCRIBED IN THE LOCAL CORRECTIONS 19 OFFICERS' TRAINING ACT. 20 Sec. 15. The department shall establish a central training 21 academy for use as an employee training center for state and 22 local correctional officers. Funds necessary for the establish- 23 ment and use of the training academy shall be provided by the 24 department and supported by separate appropriation. 25 Enacting section 1. This amendatory act does not take 26 effect unless House Bill No. 5977 of the 91st Legislature is 27 enacted into law. H04778'01 c *
