        A bill to protect and promote children's health; to create

   the MIChild program; to prescribe the powers and duties of the

   department of community health; and to prescribe certain duties

   of certain other state departments, officers, and agencies.

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

             Sec. 1.  This act shall be known and may be cited as the

        "MIChild program act".

             Sec. 2.  As used in this act:

 4
             (a) "Department" means the department of community health.

 5
             (b) "Eligible children" means children who meet the eligi-

 6
        bility requirements of the MIChild program established by the

 7
        department.

 8
             (c) "MIChild program" means the program created in

 9
        section 3.

             Sec. 3.  The MIChild program is established within the

 2
        department.  The department shall administer the MIChild

 3
        program.  The MIChild program is to be used to provide comprehen-

 4
        sive health care to children who meet the eligibility criteria

 5
        established by the department.

 6
             Sec. 4.  The department shall not use money from the MIChild

 7
        program to promote the use of or to provide a prescription for a

 8
        drug or device intended as a contraceptive to an eligible child

 9
        without consent from a parent or legal guardian of the child.
