HOUSE BILL No. 6307

A bill to amend 1980 PA 350, entitled "The nonprofit health care corporation reform act," by amending section 419a (MCL 550.1419a), as added by 1995 PA 238. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 419a. (1) If a parent is eligible for dependent cover- 2 age through a health care corporation, the health care corpora- 3 tion shall: 4 (a) Permit the parent to enroll, under the dependent cover- 5 age, a child who is otherwise eligible for coverage without 6 regard to any enrollment season restrictions. 7 (b) If the parent is enrolled but fails to make application 8 to obtain coverage for the child, enroll the child under 9 dependent coverage upon application by the friend of the court 07684'02 j GWH 2 1 CHILD or by the child's other parent through the friend of the 2 court CHILD. 3 (c) Not eliminate the child's coverage unless premiums have 4 not been paid as required by the certificate or the health care 5 corporation is provided with satisfactory written evidence of 6 either of the following: 7 (i) The court or administrative order is no longer in 8 effect. 9 (ii) The child is or will be enrolled in comparable health 10 coverage through another health care corporation, insurer, health 11 maintenance organization, or self-funded health coverage plan 12 that will take effect not later than the effective date of the 13 cancellation of the existing coverage. 14 (2) If a child has health coverage through a health care 15 corporation of a noncustodial parent, that health care corpora- 16 tion shall do all of the following: 17 (a) Provide the custodial parent with information necessary 18 for the child to obtain benefits through that coverage. 19 (b) Permit the custodial parent or, with the custodial 20 parent's approval, the provider to submit a claim for covered 21 services without the noncustodial parent's approval. 22 (c) If applicable, reimburse or make payment on claims sub- 23 mitted by the custodial parent or medical provider for services 24 obtained or provided under subdivision (b). 25 (3) This section applies only if a parent is required by a 26 court or administrative order to provide health coverage for a 07684'02 j 3 1 child and the health care corporation is notified of that court 2 or administrative order. 3 Enacting section 1.
