HOUSE BILL No. 6140 May 28, 2002, Introduced by Reps. Drolet, Gosselin, Palmer, Hummel and Vear and referred to the Committee on Civil Law and the Judiciary. A bill to amend 1927 PA 372, entitled "An act to regulate and license the selling, purchasing, possess- ing, and carrying of certain firearms and gas ejecting devices; to prohibit the buying, selling, or carrying of certain firearms and gas ejecting devices without a license or other authoriza- tion; to provide for the forfeiture of firearms under certain circumstances; to provide for penalties and remedies; to provide immunity from civil liability under certain circumstances; to prescribe the powers and duties of certain state and local agen- cies; to prohibit certain conduct against individuals who apply for or receive a license to carry a concealed pistol; to make appropriations; to prescribe certain conditions for the appropri- ations; and to repeal all acts and parts of acts inconsistent with this act," by amending section 5n (MCL 28.425n), as added by 2000 PA 381. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 5n. (1) This state or a local unit of government of 2 this state shall not prohibit an individual from doing either of 3 the following as a condition for receiving or maintaining any 4 other license or permit authorized by law: 06390'01 JJG 2 1 (a) Applying for or receiving a license to carry a concealed 2 pistol under this act. 3 (b) Carrying a concealed pistol in compliance with a license 4 issued under this act. 5 (2) Except as provided insubsectionSUBSECTIONS (3) AND 6 (4), an employer shall not prohibit an employee from doing either 7 of the following: 8 (a) Applying for or receiving a license to carry a concealed 9 pistol under this act. 10 (b) Carrying a concealed pistol in compliance with a license 11 issued under this act. This subdivision does not prohibit an 12 employer from prohibiting an employee from carrying a concealed 13 pistol in the course of his or her employment with that 14 employer. 15 (3) A police agency may prohibit an employee of that police 16 agency from carrying a concealed pistol if carrying a concealed 17 pistol would result in increased insurance premiums or a loss or 18 reduction of insurance coverage for that employer. 19 (4) NOTWITHSTANDING SUBSECTION (2)(B), AND SUBJECT TO SUB- 20 SECTION (3), AN EMPLOYEE OF THIS STATE OR A POLITICAL SUBDIVISION 21 OF THIS STATE WHO, IN THE COURSE OF HIS OR HER EMPLOYMENT, IS 22 REQUIRED TO PERFORM INSPECTIONS ON PRIVATE PROPERTY MAY CARRY A 23 CONCEALED PISTOL WHILE ON THAT PRIVATE PROPERTY IF HE OR SHE IS 24 LICENSED UNDER THIS ACT. 06390'01 Final page.
