A bill to amend 1976 PA 451, entitled "The revised school code," by amending section 1233b (MCL 380.1233b), as amended by 1995 PA 289. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 1233b. (1) Except as provided in subsection (3), the 2 board of a local or intermediate school district OR BOARD OF 3 DIRECTORS OF A PUBLIC SCHOOL ACADEMY may engage a full-time or 4 part-time noncertificated, nonendorsed teacher to teach a course 5 in computer science, a foreign language, mathematics, biology, 6 chemistry, engineering, physics, robotics, or in another subject 7 area determined by the state board to be appropriate to be 8 included under this section and so designated by the state board, 9 or any combination of these subject areas, in grades 9 7 03802'01 *** TAV 2 1 through 12 IF HE OR SHE MEETS THE REQUIREMENTS OF 2 SUBSECTION (2). 3 (2) Subject to subsection (3), a noncertificated, nonen- 4 dorsed teacher is qualified to teach pursuant to this section if 5 he or she meets all 1 OR BOTH of the following minimum 6 requirements: 7 (A) POSSESSES AN EARNED MASTER'S OR DOCTORATE DEGREE FROM AN 8 ACCREDITED POSTSECONDARY INSTITUTION IN A FIELD OF STUDY RELATED 9 TO THE SUBJECT THAT HE OR SHE IS ASSIGNED TO TEACH AND MEETS ALL 10 OF THE FOLLOWING: 11 (i) IS ANNUALLY AND CONTINUALLY ENROLLED AND COMPLETING 12 CREDIT IN AN ACCELERATED MASTER'S AND TRAINING TEACHER PREPARA- 13 TION COURSE THAT MEETS THE REQUIREMENTS OF SUBSECTION (6), AND 14 HAS NOT BEEN ENROLLED IN THAT COURSE FOR MORE THAN 36 MONTHS. 15 (ii) IF THE TEACHER HAS SUCCESSFULLY COMPLETED THE MASTER'S 16 AND TRAINING TEACHER PREPARATION COURSE, HE OR SHE MEETS THE SAME 17 CONTINUING EDUCATION REQUIREMENTS APPLICABLE TO A CERTIFICATED 18 TEACHER. 19 (iii) DURING AT LEAST HIS OR HER FIRST SEMESTER OF TEACHING, 20 TEACHES UNDER THE DIRECTION AND PERIODIC EVALUATION OF A MENTOR. 21 THIS REQUIREMENT IS IN ADDITION TO THE MENTORING REQUIREMENTS 22 UNDER SECTION 1526, BUT MAY BE MET WITH THE SAME INDIVIDUAL 23 ACTING AS MENTOR. 24 (iv) THROUGHOUT THE TEACHER'S FIRST SEMESTER OF TEACHING, 25 MEETS AT LEAST WEEKLY WITH THE SCHOOL DISTRICT SUPERINTENDENT OR 26 CHIEF ADMINISTRATOR OF THE PUBLIC SCHOOL ACADEMY, OR HIS OR HER 27 DESIGNEE, TO ASSESS THE TEACHER'S PROGRESS. IF THERE IS MORE 03802'01 *** 3 1 THAN 1 INDIVIDUAL EMPLOYED IN THE SCHOOL DISTRICT UNDER THIS 2 SUBDIVISION, THESE MEETINGS SHALL BE GROUP MEETINGS. 3 (B) (a) Possesses an earned bachelor's degree from an 4 accredited postsecondary institution . AND MEETS ALL OF THE 5 FOLLOWING: 6 (i) (b) Has a major or a graduate degree in the field of 7 specialization STUDY in which he or she will teach. 8 (ii) IS ANNUALLY AND CONTINUALLY ENROLLED AND COMPLETING 9 CREDIT IN AN APPROVED TEACHER PREPARATION PROGRAM LEADING TO A 10 TEACHING CERTIFICATE. 11 (iii) (c) If the teacher desires to teach for more than 1 12 year, has passed both a basic skills examination and a subject 13 area examination, if a AN APPLICABLE subject area examination 14 exists, in the field of specialization in which he or she will 15 teach. 16 (d) Except in the case of persons engaged to teach a for- 17 eign language, has, in the 5-year period immediately preceding 18 the date of hire, not less than 2 years of occupational 19 experience in the field of specialization in which he or she will 20 teach. 21 (3) The requirements listed in subsection (2) for a teacher 22 engaged to teach pursuant to this section shall be in addition to 23 any other requirements established by the board of a local or 24 intermediate school district OR BOARD OF DIRECTORS OF A PUBLIC 25 SCHOOL ACADEMY, as applicable. 26 (4) Except as provided in subsection (5), the THE board of 27 a local or intermediate school district OR BOARD OF DIRECTORS OF 03802'01 *** 4 1 A PUBLIC SCHOOL ACADEMY shall not engage a full-time or part-time 2 noncertificated, nonendorsed teacher to teach a course described 3 in subsection (1) if UNDER THIS SECTION UNLESS the district is 4 able OR PUBLIC SCHOOL ACADEMY DETERMINES THAT IT IS UNABLE to 5 engage a SATISFACTORY certificated, endorsed teacher USING THE 6 RECRUITMENT METHODS IT NORMALLY USES TO RECRUIT NEW TEACHERS. 7 (5) If the board of a local or intermediate school district 8 is able to engage a certificated, endorsed teacher to teach a 9 course described in subsection (1), the local or intermediate 10 school board may employ or continue to employ a noncertificated, 11 nonendorsed teacher to teach the course if both of the following 12 conditions are met: 13 (a) The noncertificated, nonendorsed teacher is annually and 14 continually enrolled and completing credit in an approved teacher 15 preparation program leading to a provisional teaching 16 certificate. 17 (b) The noncertificated, nonendorsed teacher has a planned 18 program leading to teacher certification on file with the employ- 19 ing school district or intermediate school district, his or her 20 teacher preparation institution, and the department of 21 education. 22 (5) (6) If the noncertificated, nonendorsed teacher com- 23 pletes 3 years of successful classroom teaching, as determined by 24 regular observation and review by school district OR PUBLIC 25 SCHOOL ACADEMY and teacher preparation institution personnel, the 26 department of education and a teacher preparation institution 27 shall utilize the teaching experience of a noncertificated, 03802'01 *** 5 1 nonendorsed teacher for the purpose of waiving student teaching 2 as a condition for receiving a continued employment authoriza- 3 tion in the school district and a provisional teaching 4 certificate. 5 (6) FOR THE PURPOSES OF SUBSECTION (2), A MASTER'S AND 6 TRAINING TEACHER PREPARATION COURSE SHALL MEET ALL OF THE 7 FOLLOWING: 8 (A) CONSISTS OF AT LEAST 18 COLLEGE CREDIT HOURS OR THE 9 EQUIVALENT OF 120 CLOCK HOURS OF STUDY. 10 (B) INCLUDES AT LEAST AN EQUIVALENT NUMBER OF CREDITS OR 11 HOURS OF READING INSTRUCTION AS REQUIRED UNDER SECTION 1531(4) 12 AND EQUIVALENT CONTENT. 13 (C) REQUIRES PASSAGE OF THE BASIC SKILLS EXAMINATION 14 DESCRIBED IN SECTION 1531. 15 (D) REQUIRES PASSAGE OF A SUBJECT AREA EXAMINATION, IF AN 16 APPLICABLE SUBJECT AREA EXAMINATION EXISTS, IN THE SUBJECT AREA 17 IN WHICH THE TEACHER HOLDS A MASTER'S OR DOCTORATE DEGREE. 03802'01 *** Final page.
