     October 16, 2001, Introduced by Reps. Bovin, Raczkowski, Anderson, Zelenko, Schauer, Jacobs, Rivet, Bernero, Basham, Sheltrown, Rich Brown,
Whitmer, Neumann, Frank, Mans, Kolb, Spade, Minore, Bogardus, Hardman and DeWeese and referred to the Committee on Health Policy.


        A bill to amend 1963 PA 125, entitled

   "An act to provide for the incorporation, supervision, and regu-
   lation of nonprofit dental care corporations; to prescribe the
   functions of the commissioner of insurance as to such corpora-
   tions; to provide for the imposition of a regulatory fee; and to
   prescribe penalties for violations of this act,"

   by amending section 8 (MCL 550.358).

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

           Sec. 8.  The commissioner of  insurance  THE OFFICE OF

      FINANCIAL AND INSURANCE SERVICES, after reasonable notice and

 3
      hearing, may revoke a certificate, order, or consent, made by him

 4
      OR HER and forbid applications for membership  , upon being  IF

 5
      satisfied that further solicitation of subscribers would work a

 6
      fraud upon the  persons so  PERSON solicited  .  He  OR IF
   SATIS-

      FIED THAT A CORPORATION FORMED UNDER THIS ACT HAS FAILED TO

 8
      COMPLY WITH THE HEALTH CARE INFORMATION PROTECTION AND PRIVACY

      ACT.  THE COMMISSIONER may make  such  investigations from time

      to time as he  deems  OR SHE CONSIDERS best and grant hearings to

 2
      the incorporators.   He shall have  THE COMMISSIONER HAS the same

 3
      authority in respect to taking over or liquidating a corporation

 4
      formed or doing business under this act as is provided by chapter

 5
       78 of Act No. 218 of the Public Acts of 1956, as amended, being

 6
      sections 500.7800 to 500.7868 of the Compiled Laws of 1948  81 OF

      THE INSURANCE CODE OF 1956, 1956 PA 218, MCL 500.8101 TO

 8
      500.8199A.  A dissolution or liquidation of a corporation FORMED

 9
      UNDER THIS ACT shall be conducted under the supervision of the

10
      commissioner, who shall have the same power with respect

11
       thereto  TO THE DISSOLUTION OR LIQUIDATION as granted to  him

12
      under provisions of the law  THE COMMISSIONER for the dissolution

13
      and liquidation of insurance companies.

           Enacting section 1.  This amendatory act does not take

15
      effect unless House Bill No. 4936 of the 91st Legislature is

16
      enacted into law.
