        A bill to amend 1949 PA 300, entitled

   "Michigan vehicle code,"

   by amending section 626b (MCL 257.626b).

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

           Sec. 626b.  (1) A person who operates a vehicle upon a high-

 2
      way or a frozen public lake, stream, or pond or other place open

 3
      to the general public including an area designated for the park-

 4
      ing of vehicles in a careless or negligent manner likely to

 5
      endanger any person or property, but without wantonness or reck-

 6
      lessness, is responsible for a civil infraction.

           (2) AS USED IN THIS SECTION, "CARELESS OR NEGLIGENT MANNER"

 8
      INCLUDES THE USE OF A HANDHELD CELLULAR TELEPHONE THAT PREVENTS

      THE PERSON FROM HAVING BOTH HANDS ON THE STEERING WHEEL OF THE

      VEHICLE WHILE OPERATING THE VEHICLE EXCEPT WHEN NECESSARY TO DIAL
