        A bill to amend 1978 PA 368, entitled

   "Public health code,"

   by amending section 13103 (MCL 333.13103), as added by 1996 PA

   223.

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

           Sec. 13103.  (1) A person who violates section 13102 is

 2
      guilty of a  misdemeanor, FELONY punishable by imprisonment for

 3
      not more than  90 days,  4 YEARS or a fine of not more than

 4
       $500.00  $2,000.00, or both, for each violation.

 5
           (2) A person who violates section 13102 is liable in a civil

 6
      action for actual damages or  $1,000.00  $10,000.00, whichever is

 7
      greater, plus reasonable court costs and attorney fees.
