A bill to amend 1982 PA 432, entitled "Motor bus transportation act," by amending section 31 (MCL 474.131), as amended by 1996 PA 420. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 31. This state hereby adopts the following provisions 2 of title 49 of the code of federal regulationsas of January 1,31996,on file with the office of the secretary of state except 4 where modified by this act, to provide for the safe transporta- 5 tion of persons, with the intent of following the policies and 6 procedures of the United States department oftransportation's7federal highway administrationTRANSPORTATION as they relate to 8 title 49 of the code of federal regulations and the North 9 American uniform driver/vehicle inspection standards (NAUD/VIS) 10 out of service criteria and inspection procedures: Motor carrier 11 safety regulations, being 49 C.F.R. PART 374, part 382, part 387, 02671'01 TJS 2 1 parts 390 through 393, parts 395 through 397, and part 399 2 including appendicesC, D, E,B and G, except for the 3 following: 4 (a) Where the terms "United States department of 5 transportation", "federal highway administration", "federal high- 6 way administrator", "director",and"bureau of motor carrier 7 safety", "OFFICE OF MOTOR CARRIER SAFETY", AND "FEDERAL MOTOR 8 CARRIER SAFETY ADMINISTRATION" appear, they shall be construed to 9 refer to the state transportation department. 10 (b) Where "interstate" appears, itshall meanMEANS intra- 11 state or interstate, or both, as applicable, EXCEPT AS OTHERWISE 12 SPECIFICALLY PROVIDED IN THIS ACT. 13 (c) Where "special agent of the federal highway 14 administration", "SPECIAL AGENT OF THE OFFICE OF MOTOR CARRIER 15 SAFETY", "SPECIAL AGENT OF THE FEDERAL MOTOR CARRIER SAFETY 16 ADMINISTRATION", or "administration personnel" appears,either17 IT shall be construed to mean a peace officer or an enforcement 18 member or a commercial vehicle safety inspector of the state 19 transportation department. 02671'01 Final page.
