Dennis, Kolb, Hansen, Jamnick, Rison, Woodward, Neumann, Stallworth, Richner, DeVuyst and Thomas and referred to the
Committee on Local Government and Urban Policy.


        A bill to amend 1945 PA 281, entitled

   "An act to provide for regional planning; the creation, organiza-
   tion, powers and duties of regional planning commissions; the
   provision of funds for the use of regional planning commissions;
   and the supervision of the activities of regional planning com-
   missions under the provisions of this act,"

   (MCL 125.11 to 125.25) by adding section 16.

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

           SEC. 16.  (1) NOTWITHSTANDING ANY OTHER PROVISION OF THIS

 2
      ACT, A PLAN ADOPTED UNDER THIS ACT MAY BE AMENDED OR REPEALED

 3
      PURSUANT TO THIS ACT OR THE COORDINATED PLANNING ACT.

           (2) A REGIONAL PLANNING COMMISSION ESTABLISHED UNDER THIS

 5
      ACT SHALL NOT EXERCISE POWERS PROVIDED FOR BY THE COORDINATED

 6
      PLANNING ACT WITH RESPECT TO THE GEOGRAPHIC AREA UNDER THE JURIS-

 7
      DICTION OF A REGIONAL PLANNING COMMISSION ESTABLISHED UNDER THE

 8
      COORDINATED PLANNING ACT.

           (3) A PLAN OR A SUCCESSIVE PART OF A PLAN ADOPTED UNDER THE

      COORDINATED PLANNING ACT BY A REGIONAL PLANNING COMMISSION

      SUPERSEDES A PLAN ADOPTED UNDER THIS ACT TO THE EXTENT THAT THE

 4
      ELEMENTS AND GEOGRAPHIC AREA OF THE PLAN ADOPTED UNDER THIS ACT

 5
      ARE COVERED BY THE ELEMENTS AND GEOGRAPHIC AREA OF THE PLAN OR

 6
      SUCCESSIVE PART OF THE PLAN ADOPTED UNDER THE COORDINATED PLAN-

      NING ACT.

           Enacting section 1.  This amendatory act does not take

 9
      effect unless Senate Bill No. _____ or House Bill No. 4571
