A bill to amend 1978 PA 368, entitled "Public health code," (MCL 333.1101 to 333.25211) by adding section 9205a. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 SEC. 9205A. (1) EXCEPT AS PROVIDED IN SUBSECTION (3), AN 2 ADULT ENROLLED IN AN INSTITUTION OF HIGHER EDUCATION WHO RESIDES 3 OR HAS CONTRACTED TO RESIDE IN ON-CAMPUS HOUSING IN THIS STATE 4 SHALL OBTAIN AN IMMUNIZATION AGAINST MENINGOCOCCAL DISEASE FROM 5 AN AUTHORIZED HEALTH PROFESSIONAL, PHYSICIAN, LOCAL HEALTH 6 DEPARTMENT, CLINIC, OR OTHER AGENCY OFFERING IMMUNIZATIONS. 7 (2) EXCEPT AS PROVIDED IN SUBSECTION (4), A PARENT, GUARDI- 8 AN, OR PERSON IN LOCO PARENTIS OF A CHILD ENROLLED IN AN INSTITU- 9 TION OF HIGHER EDUCATION WHO RESIDES OR HAS CONTRACTED TO RESIDE 10 IN ON-CAMPUS HOUSING IN THIS STATE SHALL PROVIDE FOR THE CHILD'S 11 IMMUNIZATION AGAINST MENINGOCOCCAL DISEASE BY AN AUTHORIZED 02177'01 DAM 2 1 HEALTH PROFESSIONAL, PHYSICIAN, LOCAL HEALTH DEPARTMENT, CLINIC, 2 OR OTHER AGENCY OFFERING IMMUNIZATIONS. 3 (3) AN IMMUNIZATION DESCRIBED IN SUBSECTION (1) IS NOT 4 REQUIRED IF THE INSTITUTION OF HIGHER EDUCATION IN WHICH THE 5 ADULT IS ENROLLED PROVIDES DETAILED INFORMATION ON THE RISKS 6 ASSOCIATED WITH MENINGOCOCCAL DISEASE AND THE AVAILABILITY AND 7 EFFECTIVENESS OF IMMUNIZATION TO THE ADULT AND HE OR SHE SIGNS A 8 WRITTEN WAIVER IN A FORM APPROVED BY THE DEPARTMENT THAT STATES 9 THAT HE OR SHE HAS RECEIVED AND REVIEWED THE INFORMATION PROVIDED 10 AND ELECTED NOT TO HAVE THE IMMUNIZATION AGAINST MENINGOCOCCAL 11 DISEASE ADMINISTERED. 12 (4) AN IMMUNIZATION DESCRIBED IN SUBSECTION (2) IS NOT 13 REQUIRED IF THE INSTITUTION OF HIGHER EDUCATION IN WHICH THE 14 CHILD IS ENROLLED PROVIDES DETAILED INFORMATION ON THE RISKS 15 ASSOCIATED WITH MENINGOCOCCAL DISEASE AND THE AVAILABILITY AND 16 EFFECTIVENESS OF IMMUNIZATION TO THE PARENT, GUARDIAN, OR PERSON 17 IN LOCO PARENTIS OF THE CHILD AND HE OR SHE SIGNS A WRITTEN 18 WAIVER IN A FORM APPROVED BY THE DEPARTMENT THAT STATES THAT HE 19 OR SHE HAS RECEIVED AND REVIEWED THE INFORMATION PROVIDED AND 20 ELECTED NOT TO HAVE THE IMMUNIZATION AGAINST MENINGOCOCCAL DIS- 21 EASE ADMINISTERED TO THE CHILD. 22 (5) AN INSTITUTION OF HIGHER EDUCATION IS NOT REQUIRED TO 23 PROVIDE OR PAY FOR AN IMMUNIZATION REQUIRED UNDER THIS SECTION. 24 (6) AS USED IN THIS SECTION, "INSTITUTION OF HIGHER 25 EDUCATION" MEANS A DEGREE OR CERTIFICATE GRANTING PUBLIC OR PRI- 26 VATE COLLEGE OR UNIVERSITY, JUNIOR COLLEGE, OR COMMUNITY COLLEGE. 02177'01 Final page.
