A bill to amend 1953 PA 232, entitled "An act to revise, consolidate, and codify the laws relating to probationers and probation officers, to pardons, reprieves, com- mutations, and paroles, to the administration of correctional institutions, correctional farms, and probation recovery camps, to prisoner labor and correctional industries, and to the super- vision and inspection of local jails and houses of correction; to provide for the siting of correctional facilities; to create a state department of corrections, and to prescribe its powers and duties; to provide for the transfer to and vesting in said department of powers and duties vested by law in certain other state boards, commissions, and officers, and to abolish certain boards, commissions, and offices the powers and duties of which are transferred by this act; to allow for the operation of cer- tain facilities by private entities; to prescribe the powers and duties of certain other state departments and agencies; to pro- vide for the creation of a local lockup advisory board; to pre- scribe penalties for the violation of the provisions of this act; to make certain appropriations; to repeal certain parts of this act on specific dates; and to repeal all acts and parts of acts inconsistent with the provisions of this act," (MCL 791.201 to 791.283) by adding section 68a. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 01059'01 DRM 2 1 SEC. 68A. (1) EXCEPT AS OTHERWISE PROVIDED IN SUBSECTION 2 (2), A PRISONER MAY BE PERMITTED TO RECEIVE VISITS FROM A MINOR 3 BROTHER, SISTER, STEPBROTHER, STEPSISTER, HALF BROTHER, OR HALF 4 SISTER IF THAT MINOR IS ON THE PRISONER'S APPROVED VISITOR LIST. 5 (2) NOTWITHSTANDING SUBSECTION (1), THE DEPARTMENT MAY DO 6 ANY OF THE FOLLOWING: 7 (A) PLACE LIMITS ON VISITING HOURS, ESTABLISH REASONABLE 8 RULES OF CONDUCT, AND ESTABLISH UNIFORM QUOTAS AT EACH INSTITU- 9 TION FOR VISITS TO PRISONERS TO PROMOTE ORDER AND SECURITY IN THE 10 INSTITUTIONS AND TO PREVENT INTERFERENCE WITH INSTITUTIONAL ROU- 11 TINE OR DISRUPTION OF A PRISONER'S PROGRAMMING. 12 (B) ESTABLISH REQUIREMENTS FOR WHO MUST ACCOMPANY THE MINOR 13 ON THE VISIT. 14 (C) DENY, RESTRICT, OR TERMINATE VISITS AS DETERMINED NECES- 15 SARY BY THE DEPARTMENT FOR THE ORDER AND SECURITY OF THE 16 INSTITUTION. 17 (3) AS USED IN THIS SECTION, "MINOR" MEANS A PERSON WHO IS 18 LESS THAN 18 YEARS OF AGE. 01059'01 Final page.
