        A bill to amend 1921 PA 207, entitled

   "City and village zoning act,"

   by amending section 12 (MCL 125.592).

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

           Sec. 12.  (1) A zoning ordinance or zoning decision shall

 2
      not have the effect of totally prohibiting the establishment of a

 3
      land use within a city or village in the presence of a demon-

 4
      strated need for that land use within either the city or village

 5
      or the surrounding area within the state, unless a location

 6
      within the city or village does not exist where the use may be

 7
      appropriately located or THE use is unlawful.

 8
           (2) A CITY OR VILLAGE SHALL NOT BE REQUIRED TO HAVE MORE

 9
      THAN 20% OF THE CITY'S OR VILLAGE'S DWELLING UNITS LOCATED WITHIN

      MOBILE HOME PARKS.

           Enacting section 1.  This amendatory act does not take

      effect unless all of the following bills of the 91st Legislature

 3
      are enacted into law:
