A bill to amend 1961 PA 236, entitled "Revised judicature act of 1961," by amending section 5807 (MCL 600.5807). THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 5807. (1) No person may A PERSON SHALL NOT bring or 2 maintain any AN action to recover damages or sums due for 3 breach of contract, or to enforce the specific performance of 4 any A contract, unless, after the claim first accrued to 5 himself THE PERSON or to someone through whom he THE PERSON 6 claims, he THAT PERSON commences the action within the periods 7 of time prescribed by this section. 8 (2) (1) The period of limitations on actions AN ACTION 9 charging any A surety on any A bond of any AN executor, 10 administrator, OR guardian is 4 years after the discharge of the 11 executor, administrator, or guardian. 00293'01 LTB 2 1 (3) (2) The period of limitations is 10 years for 2 actions AN ACTION founded upon bonds of public officers ON A 3 BOND OF A PUBLIC OFFICER. 4 (4) (3) The period of limitations on actions AN ACTION 5 founded upon bonds ON A BOND executed under sections 41.80 and 6 41.81 of the Compiled Laws of 1948 SECTIONS 80 AND 81 OF 1846 RS 7 16, MCL 41.80 AND 41.81, is 2 years after the expiration of the 8 year for which the constable was elected. 9 (5) (4) The period of limitations is 10 years for actions 10 founded upon covenants in deeds and mortgages AN ACTION FOUNDED 11 ON A COVENANT IN A DEED OR MORTGAGE of real estate. 12 (6) (5) The period of limitations is 2 years for actions 13 AN ACTION charging any A surety for costs. 14 (7) (6) The period of limitations is 2 years for actions 15 AN ACTION brought on bonds or recognizances A BOND OR 16 RECOGNIZANCE given on appeal from any A court in this state. 17 (8) (7) The period of limitations is 10 years for actions 18 on bonds, notes, or other like instruments which are AN ACTION 19 ON A BOND, NOTE, OR OTHER SIMILAR INSTRUMENT THAT IS the direct 20 or indirect obligation of, or were WAS issued by although not 21 the obligation of, the THIS state of Michigan or any A 22 county, city, village, township, school district, special assess- 23 ment district, or other public or quasi-public corporation in 24 the THIS state. of Michigan. 25 (9) THE PERIOD OF LIMITATIONS IS 2 YEARS FOR AN ACTION TO 26 COLLECT FEES FOR SERVICES RENDERED BY AN ATTORNEY. 00293'01 3 1 (10) (8) The period of limitations is 6 years for all 2 other actions to recover damages or sums due for breach of 3 contract. 00293'01 Final page.
