BREAST CANCER AWARENESS PLATE - H.B. 5122 (H-2): FLOOR ANALYSIS

CONTENT
The bill would amend the Michigan Vehicle Code to require the Secretary of State to develop, and permit the Secretary of State to issue, a State-sponsored "Breast Cancer Awareness" fund-raising license plate and a matching collector plate. The Secretary of State would have to deposit donations from the plates into a proposed "Breast Cancer Awareness Fund", and distribute money from the Fund to the American Cancer Society Great Lakes Division. The Secretary of State would have to design the plate, and the pink ribbon emblem of the Susan G. Komen Breast Cancer Foundation would have to appear on it.
The Breast Cancer Awareness plates would be developed and issued under existing sections of the Code that provide for State-sponsored fund-raising plates. (Under the Code, a person may apply for a fund-raising plate instead of a standard registration plate, and must pay the regular registration fee, a $25 donation, and a $10 service fee. A person may purchase a collector plate by paying a $25 donation and a $10 service fee.)
The Secretary of State would have to deposit the donation for a Breast Cancer Awareness plate into the Breast Cancer Awareness Fund, which the bill would create within the Department of Treasury. The State Treasurer could receive money or assets from any source for deposit into the Fund. The State Treasurer would have to direct investment of the Fund, crediting any interest and earnings to it. Any money left in the Fund at the end of the fiscal year would remain in the Fund, rather than lapse to the General Fund. The State Treasurer would have to distribute the money to the American Cancer Society Great Lakes Division on a quarterly basis to support research, programs, and services related to breast cancer. The recipient would have to provide an annual accounting of the use of the money to the State Treasurer.
The bill would take effect on May 1, 2003, and is tie-barred to House Bill 4352, which would create Ducks Unlimited and "Choose Life" fund-raising license plates, and Senate Bill 614, which would create a "Support Education" fund-raising license plate.

FISCAL IMPACT
This bill would have no fiscal impact on State or local government. The statutes for existing fund-raising license plates cited by the bill set a service fee of $10. The level of this fee was established following an evaluation of the administrative, manufacturing, and distribution costs of the plates. The $10 service fee is revenue-neutral, meaning it covers exactly the cost of producing the plate and the State experiences no net gain or loss.
