MISSING PERSONS REPORTS - S.B. 1368: COMMITTEE SUMMARY

Senate Bill 1368 (as enrolled)

Sponsor: Senator William Van Regenmorter

Committee: Judiciary

Date Completed: 11-12-02

CONTENT

The bill would amend the uniform crime reporting Act to require that law enforcement agencies take certain actions in regard to a missing persons report, if the individual reported missing had Alzheimer's disease or dementia.

Under the Act, if an individual who has a physical or mental disability is reported missing, the law enforcement agency receiving the report, after conducting a preliminary investigation, must immediately enter certain information regarding that individual into the Law Enforcement Information Network (LEIN), the National Crime Information Center, and, if the missing individual is a child, the Missing Child Information Clearinghouse. The bill specifies that "mental disability" would include Alzheimer's disease and dementia.

In addition, the Act provides that, if an individual reported missing is a child and is subject to the policy established by the Clearinghouse, the law enforcement agency receiving the missing persons report must broadcast certain information over the LEIN to all of the following:

-- All law enforcement agencies having jurisdiction of the location where the missing person lives or was last seen.

-- Any other law enforcement agency that potentially could become involved in locating the missing person.

-- All law enforcement agencies to which the individual who reported the missing person requests the information to be sent, if the request is reasonable.

The bill would extend that broadcasting requirement to cases in which the individual reported missing had Alzheimer's disease or dementia.
