CONTENT
Senate Bills 525, 746, and 747 amended the Public Health Code, the Business Corporation Act, and the Michigan Limited Liability Company Act, respectively, to allow a nursing home to use in its name the term "health center", "health care center", or "rehabilitation center", or a term conveying a similar meaning as long as it is not prohibited by the Public Health Code. Senate Bills 746 and 747 were tie-barred to Senate Bill 525.
Senate Bill 525 amended the Public Health Code to delete "rehabilitation center" from the terms that a nursing home may not use in its name. The bill retained the provision that a nursing home may not use in its name the terms "hospital", "sanitarium", or a term conveying a meaning that is substantively similar to those terms. The bill specifies that a nursing home may use the terms "rehabilitation center", "health center", or "health care center", or a term conveying a substantively similar meaning to those terms as long as it is not prohibited by the Code.
The bill requires a nursing home using the term "rehabilitation center" in its name to have the capacity to provide rehabilitation services that include, at a minimum, physical therapy, occupational therapy, and speech therapy services.
Senate Bill 746 amended the Business Corporation Act to allow a corporation existing under the Act that is licensed as a nursing home under the Public Health Code to use in its name the term "health center", "health care center", or "rehabilitation center", or any term conveying a similar meaning as long as it is not prohibited by the Public Health Code.
Senate Bill 747 amended the Michigan Limited Liability Company Act to allow a limited liability company existing under the Act that is licensed as a nursing home under the Public Health Code to use in its name the term "health center", "health care center", or "rehabilitation center", or any term conveying a substantively similar meaning as long as it is not prohibited by the Public Health Code.
