HANDICAPPED PARKING PERMIT - S.B. 362 (S-1): FLOOR ANALYSIS

Senate Bill 362 (Substitute S-1 as reported)

Sponsor: Senator Bev Hammerstrom

Committee: Transportation and Tourism

CONTENT

The bill would amend the Michigan Vehicle Code to permit the Secretary of State to accept from a disabled individual an application for a windshield placard, special registration plate, or free parking sticker that was signed by a physician licensed to practice in another state if the application were accompanied by a copy of that physician's current medical license issued by that state.

Under the Code, a disabled person may apply, on a form prescribed by the Secretary of State, for a serially numbered nontransferable temporary or permanent windshield placard for the disabled person's personal use. An application for an initial free parking sticker must contain a certification by a physician licensed to practice in this State attesting to the nature and estimated duration of the applicant's disabling condition and verifying that the applicant qualifies for a free parking sticker. An individual who has a religious objection to having a medical examination by a physician may personally apply at a Secretary of State branch office for temporary or permanent windshield placard or an initial free parking sticker. In the case of an individual applying for a windshield placard, if it appears obvious that he or she has a qualifying disability, the individual is not required to present a medical statement attesting to the disability. When an individual applies for a free parking sticker, if it appears obvious that he or she is unable to do one of more of the acts listed in the Code, the individual is not required to present a physician's certification.
