A SUMMARY OF HOUSE BILL 6134 AS INTRODUCED 5-28-02

The bill would create the Joint Municipal Planning Act under which the legislative bodies of two or more cities, villages, or townships could agree to establish a joint planning commission. A joint planning commission could exercise any powers and perform any duties of a planning commission under the applicable planning act. The agreement creating the joint commission would specify which planning act was to be followed (either the General Municipal Planning Act or the act governing township planning).

The agreement creating the joint commission would also specify the composition of the commission, including alternate members; the qualifications, election or appointment, and terms of office of members; the conditions and procedures for removal of commission members from office; how the operating budget was to be shared; and the procedures for a municipality to join or withdraw from the joint commission. The agreement would also specify the jurisdictional area of the joint commission, which could consist of all or part of the combined territory of the participating municipalities.
