A SUMMARY OF HOUSE BILL 5504 AS INTRODUCED 12-12-01

House Bill 5504 would amend the Michigan Vehicle Code to require a criminal background check on applicants for commercial drivers' licenses. Under the bill, the secretary of state would be prohibited from issuing a vehicle group designation to an applicant if the applicant had not submitted a set of fingerprints as prescribed, or the comparison fingerprint reports had not been received by the department.

More specifically and under the bill, an applicant for a vehicle group designation or indorsement would be required to submit a set of fingerprints, on forms or in a manner prescribed by the Department of State Police, with his or her application for an operator's or chauffeur's license, before being issued a group designation or indorsement (other than a motorcycle indorsement). After receiving a set of fingerprints, the Department of State Police would be required to compare them with those already on file, and also forward a copy of the fingerprints to the Federal Bureau of Investigation for comparison with fingerprints already in the bureau's files. Then the Department of State Police would request a report of the comparison made by the Federal Bureau of Investigation, and prepare a report of the comparison made by the Department of State Police, and forward both comparison reports to the Department of State.

Under the bill, the Department of State would be prohibited from issuing a vehicle group designation or indorsement (other than a motorcycle indorsement) on an operator's or chauffeur's license if either of the fingerprint comparison reports received from the Department of State Police indicated that the applicant had been convicted of a violation of chapter LXXXIII-A of the Michigan Penal Code. (Chapter LXXXIII-A of the Penal Code is embodied in a series of bills currently before the legislature that, together, will form a new chapter of the code entitled "Terrorism.")
