A SUMMARY OF HOUSE BILL 5492 AS INTRODUCED 12-11-01
House Bill 5492 would amend the Revised School Code to require the Department of Education to compile, maintain, and make available to school districts a list of contractors who have worked on school construction projects in Michigan. The list would be intended to help school officials make informed decisions in selecting contractors for school construction projects.
The bill specifies that the contractors list would consist of information voluntarily submitted by school districts (including intermediate school districts) and public school academies that had experience with a contractor on a school construction project, including but not limited to:
-the contractor's name;
-the type of project or projects involved;
-information about the contractor's performance, including any of the following: (i) a rating of the contractor's performance according to a rating system developed by the department; (ii) information on the type and quality of work performed by the contractor on the project; and, (iii) information concerning any problems encountered with the contractor on the project, such as noncompliance with the contract, delays, or poor workmanship; and,
-recommendations of contractors, either overall or for particular types of work or projects.
The bill further specifies that the department would notify school districts and public school academies of the opportunity to submit information about contractors, and develop and make available to them a form for reporting the information. The form would include instructions for completion of the form, including at least a rating system for rating a contractor's performance. After the list had been established, the department would be required to notify school districts and public school academies of its availability.
Under the bill, "contractor" includes a general contractor, or a subcontractor.
