A SUMMARY OF HOUSE BILL 5438 AS INTRODUCED 11-1-01

The bill would amend the Family Support Act to require a court to consider entering an order for parenting time for a noncustodial parent, upon the parent's motion. When determining the parenting time, the court would follow the standards and criteria set forth in the Child Custody Act. If there were a dispute concerning parenting time, the court would immediately enter an order establishing support and a temporary parenting time schedule with the child. Before a hearing on the dispute or resolution of the dispute without a hearing, the court could also refer the matter to the Friend of the Court for a report and recommendation pertaining to parenting time. In a dispute regarding parenting time, the prosecuting attorney, an attorney appointed by the county, or an attorney appointed by the court would not be required to represent either party regarding the dispute.
