A SUMMARY OF HOUSE BILL 5230 AS INTRODUCED 10-16-01

House Bill 5330 would amend the Mental Health Code (MCL 330.1149c) to add a requirement that a psychiatric hospital, psychiatric unit, or psychiatric partial hospitalization program operated and licensed by the Department of Community Health comply with specific sections of the proposed Health Care Information Protection and Privacy Act. The specific sections set forth the duties of health care providers, third party payers, and health information custodians that receive health care information and certain other requirements concerning the maintenance, transferal, and destruction of health care information. The bill is tie-barred to House Bill 4936, which would establish the Health Care Information Protection and Privacy Act.
