A SUMMARY OF HOUSE BILL 5101 AS INTRODUCED 9-25-01
House Bill 5101 would amend the Michigan Vehicle Code to require that the crash report form completed by police officers after a traffic accident indicate whether a cellular phone was in use by one or more of the drivers at the time of the crash. Further, the bill would require that the citation form completed after traffic accidents also contain a space for the police officer to indicate whether the defendant was using a cell phone at the time of the alleged civil infraction. Under the bill, the clerk of the court would be required to forward an abstract of the court record to the Department of State Police upon a person's conviction for a code violation for which the crash report or the citation form indicated that the person was using a cell phone. Further, the Department of State Police would be responsible for compiling separate statistics on the amount of cell phone use, based on the information gathered from the crash reports and citation forms.
