Father William Turner, Pastor of St. Mary's Parish in Chelsea, offered the following invocation:

 

"God, source of all wisdom, Your statutes are good and gracious to us, and Your law is truth, guide and direct our state legislature, that by just and prudent laws, they may promote the well-being of our people.

You have charged us with the task of building on this earth a home where all nations may dwell in unity, liberty and peace. We pray for strength, that our government may be able to fulfill roles of service and responsibility, that they may seek justice, protect the weak, and lead us in the work of peace. Grant strength and courage that our elected officials are able to employ the principles of freedom, and ideals in the struggle for justice among all people. Through their work may barriers come down that could divide us and any spirit of hatred be ended.

In the midst of our complex and hurried lives, remind us of our simple roots. We give thanks to You for our nation. We commend our country to Your care at this time. Following Your guidance, may we bring an end to the evil of terrorism, so that all people may live in peace. Give to our President, our Governor, and to all in authority, the wisdom and strength to know Your will. Preserve and increase our liberties, and fashion into one nation, this people of many races. We pray today that You fill with the spirit of wisdom those we entrust to the authority of our state government. In time of prosperity, fill out hearts with thankfulness. In time of trouble, do not allow our trust in You to fail. Bless this place and these our elected servants! Amen."

A bill to amend 1951 PA 51, entitled "An act to provide for the classification of all public roads, streets, and highways in this state, and for the revision of that classification and for additions to and deletions from each classification; to set up and establish the Michigan transportation fund; to provide for the deposits in the Michigan transportation fund of specific taxes on motor vehicles and motor vehicle fuels; to provide for the allocation of funds from the Michigan transportation fund and the use and administration of the fund for transportation purposes; to set up and establish the truck safety fund; to provide for the allocation of funds from the truck safety fund and administration of the fund for truck safety purposes; to set up and establish the Michigan truck safety commission; to establish certain standards for road contracts for certain businesses; to provide for the continuing review of transportation needs within the state; to authorize the state transportation commission, counties, cities, and villages to borrow money, issue bonds, and make pledges of funds for transportation purposes; to authorize counties to advance funds for the payment of deficiencies necessary for the payment of bonds issued under this act; to provide for the limitations, payment, retirement, and security of the bonds and pledges; to provide for appropriations and tax levies by counties and townships for county roads; to authorize contributions by townships for county roads; to provide for the establishment and administration of the state trunk line fund, critical bridge fund, comprehensive transportation fund, and certain other funds; to provide for the deposits in the state trunk line fund, critical bridge fund, comprehensive transportation fund, and certain other funds of money raised by specific taxes and fees; to provide for definitions of public transportation functions and criteria; to define the purposes for which Michigan transportation funds may be allocated; to provide for Michigan transportation fund grants; to provide for review and approval of transportation programs; to provide for submission of annual legislative requests and reports; to provide for the establishment and functions of certain advisory entities; to provide for conditions for grants; to provide for the issuance of bonds and notes for transportation purposes; to provide for the powers and duties of certain state and local agencies and officials; to provide for the making of loans for transportation purposes by the state transportation department and for the receipt and repayment by local units and agencies of those loans from certain specified sources; and to repeal acts and parts of acts," by amending section 10n (MCL 247.660n) as added by 1987 PA 234.

A bill to amend 1933 (Ex Sess) PA 18, entitled "An act to authorize any city, village, township, or county to purchase, acquire, construct, maintain, operate, improve, extend, and repair housing facilities; to eliminate housing conditions which are detrimental to the public peace, health, safety, morals, or welfare; and for any such purposes to authorize any such city, village, township, or county to create a commission with power to effectuate said purposes, and to prescribe the powers and duties of such commission and of such city, village, township, or county; and for any such purposes to authorize any such commission, city, village, township, or county to issue notes and revenue bonds; to regulate the issuance, sale, retirement, and refunding of such notes and bonds; to regulate the rentals of such projects and the use of the revenues of the projects; to prescribe the manner of selecting tenants for such projects; to provide for condemnation of private property for such projects; to confer certain powers upon such commissions, cities, villages, townships, and counties in relation to such projects, including the power to receive aid and cooperation of the federal government; to provide for a referendum thereon; to provide for cooperative financing by 2 or more commissions, cities, villages, townships, or counties or any combination thereof; to provide for the issuance, sale, and retirement of revenue bonds and special obligation notes for such purposes; to provide for financing agreements between cooperating borrowers; to provide for other matters relative to the bonds and notes and methods of cooperative financing; for other purposes; and to prescribe penalties and provide remedies," by amending sections 17 and 47 (MCL 125.667 and 125.697), as amended by 1996 PA 338; and to repeal acts and parts of acts.

Whereas, It is a pleasure to join with their families, school, and the entire city of Auburn Hills in honoring the Avondale High School Boys Basketball Team for bringing home the State Championship for the very first time. The impact of the championship on Saturday, March 23, 2002, will be with the team members for the remainder of their lives. Significant images will be forever etched in the team's minds knowing that they were present and had a part in making history; and

Whereas, It is a pleasure to join with their families, entire school, and all of Wyoming, Michigan, in celebrating the achievements of the Tri-unity Christian High School Boys' Basketball Team on its wonderful success over the season. With the fine record this squad attained, which has culminated in the 2002 Class D State Championship, this group of disciplined student-athletes has generated great pride throughout this part of our state; and

Whereas, Much to the delight of their loyal fans, the Defenders have also earned the respect of prep sports followers throughout Michigan with their talent, teamwork, and determination. As opponents have found out all season long, this is a team that brings unity and a positive outlook to all levels of competition. In the face of challenge and pressure, this is a group of young people who maintain their focus on achieving their goals and accepting nothing less than their best effort; and

Whereas, Winning titles or compiling outstanding seasons is never easy. While anything can happen in a single game, all teams show their true abilities and dedication over a long season or a difficult tournament. What distinguishes the best, however, is usually the effort that appears in practice, far removed from the excitement of game day. Whereas, The Republic of China has a population larger than 75 percent of WHO members, is a vibrant democracy, and is an economic state that has continued to play an important role in the international arena, as seen through the collaboration of the United States Center for Disease Control and Prevention and its Taiwanese counterpart; and

Whereas, The World Health Association (WHA) has allowed observers to participate in the activities of this organization in the past and will be holding a 5-day summit in Geneva, Switzerland, on May 13, 2002; now, therefore, be it

EXECUTIVE REORGANIZATION

 

WHEREAS, the family constitutes the basic unit of society, children represent the future of our state and society, and government policies should encourage and recognize the involvement and contributions of both parents in the successful upbringing of their children; and

WHEREAS, the payment of child support contributes to family self-sufficiency, fosters responsible behavior toward and by children, and sends a powerful message to children about the support of both parents; and

WHEREAS, the benefits of establishing paternity and the involvement of both parents include a sense of identity, financial support, social security, insurance, inheritance rights, and access to important family medical history; and

WHEREAS, the child support enforcement program in Michigan is operated through a partnership of the state and counties, the success of which relies on the contributions and efforts of all branches of government.

NOW, THEREFORE, I, John Engler, Governor of the state of Michigan, pursuant to the powers vested in me by the Constitution of the state of Michigan of 1963 and the laws of the state of Michigan, do hereby order the following, concurrent with the Michigan Supreme Court Administrative Order issued on this date:

A. "Council" means the Michigan Child Support Leadership Council established by this Executive Order.

D. "State Court Administrative Office" means the office established by the Michigan Supreme Court to perform administrative duties as assigned by the court pursuant to Article VI, Section 3, of the Constitution of the state of Michigan of 1963.

II. ESTABLISHMENT OF THE CHILD SUPPORT LEADERSHIP COUNCIL

A. The Michigan Child Support Leadership Council is hereby established as an advisory body to the Executive Office of the Governor and the Michigan Supreme Court.

B. The council shall consist of nine (9) members:

1. Four (4) appointed by the Governor;

2. Four (4) appointed by the Chief Justice; and,

3. One (1) appointed jointly by the Governor and Chief Justice from a list of three (3) nominees submitted by the Prosecuting Attorneys Association of Michigan.

C. Except as otherwise provided in this subsection, appointees shall hold office for a term of two (2) years. However, of the appointees initially appointed, the Governor shall designate two (2) of the Governor's appointees to serve a term of one (1) year, and the Chief Justice shall designate two (2) of the Chief Justice's appointees to serve a term of one (1) year.

D. A vacancy on the council caused by the expiration of a term or other cause of termination of membership on the council shall be filled in the same manner as the original appointment.

E. An appointee appointed to fill a vacancy created other than by expiration of a term shall be appointed for the unexpired term of the appointee who he or she is to succeed in the same manner as the original appointment. An appointee may be reappointed for additional terms.

III. CHARGE TO THE COUNCIL

The council shall be advisory in nature and shall assist the Governor and the Michigan Supreme Court with the following functions:

A. The council shall develop recommendations for statewide program goals and objectives for the child support program for submission to the Governor and the Chief Justice as follows:

1. Each year the council shall submit recommendations for annual statewide goals and objectives, as well as strategies to accomplish those goals and objectives, to the Governor and Chief Justice. Copies of the recommendations shall also be provided to the Director of the Family Independence Agency and the State Court Administrator. The Governor and Chief Justice, within sixty (60) days, may amend the recommendations and approve them or approve them as submitted.

2. The council shall submit an interim report on its recommendations to the Governor and Chief Justice by September 30, 2002. Thereafter, the Council shall submit annual reports on its recommendations to the Governor and Chief Justice by December 31st each year, beginning in December 2002. The annual reports shall include a summary of issues reviewed by the Council for the calendar year for which the report is issued.

B. The council shall continuously provide reviews of and comments on child support program policies and procedures to the Family Independence Agency and the State Court Administrative Office.

C. The council shall regularly analyze and recommend state positions on pending and proposed changes in court rules and federal and state legislation to the Family Independence Agency and the State Court Administrative Office.

IV. OPERATIONS OF THE COUNCIL

A. The Governor and the Chief Justice shall each designate a member of the council to serve as co-chairperson of the council who shall share the powers of directing the council equally. The co-chairpersons shall serve as co-chairpersons at the pleasure of the Governor and the Chief Justice respectively.

B. The council may adopt procedures, not inconsistent with law and with this Order, governing its organization, operation and procedure.

C. Members of the council shall not delegate their responsibilities to other persons. A majority of the serving members constitutes a quorum for the transaction of business at a meeting. The council shall act by a majority vote of its serving members.

D. The council shall meet at least quarterly and at the call of the co-chairpersons as may be provided in the procedures of the council. Meetings of the council may be held at any location within the state of Michigan.

E. In developing recommendations, the council may, as appropriate, make inquiries, studies, investigations, hold hearings, and receive comments from the public. The council may consult with outside experts in order to perform its duties.

F. Policy changes in federal or state laws or court rules shall be presented to the council by the Office of Child Support (federal or state law change), the State Court Administrative Office (state law or court rule change), or be submitted to either co-chairperson from other sources. The council shall develop a format for presentation and discussion of issues, which shall include an opportunity for issues to be raised through information sharing during regular meetings or to be placed on the agenda through either co-chairperson.

G. If the council cannot reach agreement on an issue requiring its recommendation, the alternative positions shall be documented in writing for consideration by the Governor and Chief Justice.

H. Members of the council shall serve without compensation. Members of the council may receive reimbursement for necessary travel and expenses according to relevant statutes, rules and procedures of the Department of Management and Budget, the Civil Service Commission, and the State Court Administrative Office.

I. Members of the council shall refer all legal, legislative and media contacts to the Executive Office of the Governor and the Michigan Supreme Court.

J. The council shall be staffed by personnel within the Executive Office of the Governor, the Michigan Supreme Court, the Family Independence Agency and the State Court Administrative Office.

K. All departments, committees, commissioners or officers of the state or of any political subdivision thereof shall give to the council, or to any member or representative thereof, any necessary assistance required by the council, or any member of representative thereof, in the performance of the duties of the council so far as is compatible with its, his or her duties; free access shall also be given to any books, records or documents in its, his or her custody, relating to matters within the scope of inquiry, study or investigation of the council.

V. MISCELLANEOUS

A. Any suit, action or other proceeding lawfully commenced by, against or before any entity effected by this Order, shall not abate by reason of the taking effect of this Order. Any suit, action or other proceeding may be maintained by, against or before the appropriate successor of any entity affected by this Order.

B. Executive Order 1997-17, creating the Child Support Coordinating Council, is hereby rescinded in its entirety as of the effective date of this order. The Child Support Coordinating Council created by Executive Order 1997-17 is hereby abolished as of the effective date of this Order.

C. The invalidity of any portion of this Order shall not affect the validity of the remainder thereof.

The provisions of this Executive Order shall become effective upon filing.

NATIONAL GUARD ASSISTANCE

 

WHEREAS, on April 15 and 16, 2002, a combination of ice dams and rapid snowmelt has resulted in severe flooding in the city of Ironwood, Gogebic County.

WHEREAS, the county of Gogebic has declared a local state of emergency and activated the disaster response and recovery aspects of their emergency operations plan to cope with the situation; and

WHEREAS, I have previously declared a state of emergency to exist in the city of Ironwood and county of Gogebic on April 16, 2002;

WHEREAS, the city of Ironwood has requested the assistance of the Michigan National Guard to provide sandbags, manpower and technical flood fighting assistance to protect the public health, safety and welfare; and

NOW, THEREFORE, by virtue of the constitutional authority vested in me as Commander-in-Chief of the military forces of the State of Michigan and pursuant to Section 151 of Act No. 150 of the Public Acts of 1967, the Adjutant General is hereby directed to order to active state service, units and individuals of the Michigan National Guard which in his discretion he deems appropriate to meet general mission assignments as determined by the state director of emergency management, or his authorized representative. Units or individuals called to active state service will terminate at such time as determined by the Adjutant General after consultation with the state director of emergency management or his representative.

FURTHER, the Emergency Management Division of the Department of State Police shall coordinate and maximize all state efforts, including such units and individuals of the Michigan National Guard which may be activated to state service to assist local units of government affected pursuant to the Michigan Emergency Management Plan.
